Not an attorney, the concussion would have me concerned about the long-term affects. I’d consult w a medical professional before talking to an attorney to discuss the severity of the concussion, and any potential long-term effects. Based on that consultation, I’d consider an attorney to make sure insurance doesn’t try to drop check me

I’d also look into if the car insurance will cover a new car seat for her daughter. I have heard that most companies will offer a replacement car seat if a child is involved in a MVA as there are too many “what ifs” that could compromise the integrity of the car seat.

so you don't think it's wise to consult an attorney to protect her from an injury that has yet to show itself?

head-on collision, not her fault, hit her head on the steering wheel, bags deployed, and headaches.

Just looking for thoughts on the current tort reform climate.

I guess it’s not that bad, I see billboards everywhere when I come back to BR.

As plaintiff or a defendant?

Plaintiff: sure she will need quarterly unnecessary nerve burns and spine manipulations/shots/procedures on her alleged back injury that doesn’t actually show up on medical tests/exams; she’ll need to have her family and friends lie for her on the stand and state how depressed and totally different of a person she is since the accident as well. Remind her to wiggle and act uncomfortable at trial too if it gets that far lol(advice from jury member at Dudley trial)

Defendant: let her insurance company hire the defense attorney if it comes to that but my guess is the at fault driver will still sue her/her insurance

Unfortunately today the best course of action when in a wreck that isn't your fault is to immediately get a lawyer. You know the insurance company is going to screw you over without one and you never know if the other driver will try to. It's not to "get paid" it is to be made whole. My dad refused to get a lawyer when he got hit in his work truck, a pretty new truck, it was out of commission for 6 months and has never been right. He didn't get any type of diminished value and I am pretty sure they sourced non OEM and used parts for his truck. That thing just doesn't drive right anymore, so much so I don't even like to drive it.

Get a lawyer.

Do you remember years back there was a funny discussion here about adding a disclaimer to posts not to be misconstrued as being legal advice or forming an atty/client relationship?

Go to your doctor. If you’re hurt and require medical expenses, then maybe. If you’re not, then no.

If she hadn’t been to a chiropractor by now her case is doomed. All the worst injuries go to the chiropractor

I was in a similar accident 30 years ago. No serious injuries but to this day, when I approach an intersection with a light at a decent rate of speed, I say “green light. green light” very quietly. No amount of money would stop me from doing that. She’ll be fine.

A concussion is a brain injury. She needs to consult with a neurologist, but she needs the right neurologist.

Get diminished value claim and sue for damages. End of story.

If you don’t get a lawyers, you get screwed, they won’t give you fair diminished value and will play games.

F them, get the lawyer. It is what it is.
