OT Lawyers - Should My Niece Retain a Lawyer? (Car Wreck)

Looking for general advice from OT experts on seeking a personal injury lawyer for my niece. I haven’t practiced tort law in several decades, and moved from Louisiana before tort reform took effect.

She was involved in a head-on collision in Baton Rouge roughly two weeks ago. She was driving through an intersection and a driver coming from the opposite direction turned into her lane, causing the accident. Her 2 year old daughter was in the backseat (car seat). Thankfully no one was seriously injured, including the driver who caused the accident.

The airbags deployed and she suffered a concussion from hitting her head on the dash or the windshield, along with multiple bruises. Her CT scans thankfully showed no brain bleeding but her headaches persisted for several days. Since the accident she has also had severe anxiety.

Her daughter in the back seat suffered abrasions from the seatbelts across her neck.

Should she consult an attorney given the current state of tort law? I told her if she does, to avoid billboard types. I know a few professional but small firms who have a lot of experience in the area.

Yes. If you are an attorney you would know that this would be the smart move in 57 of the 50 states and Puerto Rico.

i have been practicing law in Baton Rouge since 1991, and have done personal injury. I now send everything to Greg Rozas. (225) 523-6457 because he's good.

So she’s fine and has no injuries just has anxiety which is probably completely normal after an accident. Move on and count your blessing. But you are wondering whether or not y’all should be scumbags and try to get a pay day from the insurance companies. You and Gordon are the problem sir.

You don't even say if the insurance covered medical costs.

She should’ve asked to be transported to ER via ambulance and faked a dozen or so injuries.

Yes, both drivers were insured and have medical coverage.

She is reluctant to hire an attorney but another family member told her most lawyers hire on a contingency fee basis and she may be able to collect compensation due under the law.

I think she’s having an inner conflict with her political beliefs and wanting to seek Justice for her daughter.

This confusing to me but didn't you say her daughter is ok except for a abrasion on the neck?

If so what justice is there except for paying the medical bills associated with the abrasion?

What's the goal here? To be made whole on the vehicle damage and associated medical bills? Because a normal insurance company process will do that. Or is she looking for a big payday? If that's it then consult with a lawyer and quit posting about it on TD.

Good luck I hope you get your answer on here. I'm happy there were no major injuries and your family is ok. Hopefully the driver of the other vehicle insurance is easy to work with. If not then have her lawyer up. Insurance companies are hard to deal with.

If she gets a lawyer Get Gordon so we can pay for some better defensive prospects and maybe a centerfielder that can hit.
