Probably safe to assume plaintiff, since if they needed a defense attorney their malpractice carrier would be providing them one unless they were outside their policy coverage and are royally screwed.

Medmal attorneys screen about 30-40 cases before one is even worth looking into. The majority of people don't understand the difference between a poor outcome and malpractice.
