I would be interested to know how you know the car was going 55MPH. I seriously doubt the driver would admit to that since it would be speeding on that part of Nicholson. If they lied about their story then they would lie about speeding.
I don't want to blame the victim but he probably wasn't paying attention, unless the car ran a red light then he should not have been in the road and he should have seen a car coming. Hope he heals up, though, but don't be so quick to place all the blame on the driver.
