OMV data breach - what is our recourse?

I received a lengthy email today from the OMV talking about the data breach.

The data that was released, the fraud that could occur with our data being used, risk of identify theft, and how our credit scores could be impacted.

I scrolled and scrolled looking for any mention of what is our recourse as the affected Louisiana residents. Nada, no mention of any of that.

Any "payouts" of course would be paid for by Louisiana residents anyway, so what accountability does the state have in being lax about their IT controls to allow this data breach to occur?

You can freeze your credit if so inclined. That may be about it though.

Yeah, I got that one too. They offer a year of LifeLock, which is garbage. There is a class-action lawsuit starting up, but that does no thing for the thousands who will see their finances destroyed.

This breach happened about 4 months ago. Are you just now finding out about it?

If it makes you feel better, this information was likely already on the Dark Web from a different hack.

The best part about the whole situation is it took them 4 entire months to come up with that garbage email to notify people. That should have happened 3.9 months ago

They do offer a free life lock subscription for a year.

Not worried about it. Everything from your social security number to butthole pics you didn't take is already on the dark web.

Apparently they think 1 year of Lifelock Standard is enough compensation for having all of your information stolen. Also worth noting that in this case, for once, Louisiana does not appear to be at fault.

I'm curious about the total number of victims of the MoveIt breach. LA OMV, multiple universities, financial institutions, state and federal departments, DHL Shipping, and the list just keeps growing.

eta: Lifelock's standard plan looks like simple credit monitoring. Same thing offered by most banks, Credit Karma, etc.

You have to do the work yourself to freeze/lock your credit.

I got the same email last week. My credit bureaus are already frozen. But when I clicked on the link for the free LifeLock, it just brought me to a State of Louisiana website that said nothing at all about free LifeLock.

I'm sure they will happily add a few new fees for any service to offset the efforts required to prevent this from happening in the future.... (attempted efforts)

This was total incompetence on the part of the state, the 'IT community' was alerted over a week before this vulnerability went public.

When you get to that landing page there is a drop down menu in the top right or top left that has a tab for it under "protection enrollment"

To be fair, this has been the response to every data breach I have seen.

Plus, for those thinking they can sue; it will be a civil suit, so unless/until you have damages that can be traced to the breach what will you be suing for? And by throwing out the 1 year lifelock and other tips to protect yourself, they now have the defense that they gave you enough to protect yourself. If you don’t take those basic steps to protect yourself, why should they be liable BS.
