I don't think so, but that's an opening bid, essentially. The lawyer knows she won't get that much but is following the old maxim of shooting for the stars so you can land on the moon.

Virginia is an equitable distribution state, so if she financed his entire deal - paid for his resonator lessons, bought his iPhone that he recorded the songs with, paid for his housing, handled the publishing paperwork for his songs, etc., all of which done after their marriage, then she'd have a claim for a share of future his income. Also sounds like he was in and out of work and the hospital from 2013-23 and suffered some rather significant mental health problems during that time. If she was his majority means of support during that time, and a major factor in his later success, then she would have a claim to a larger percentage, but I don't see it being 60%.
