They always say that eyewitness testimony is inherently unreliable - if a guy barges into a room of 20 people brandishing a gun and then left, when you questioned the people in the room you'd get wildly different versions of what he was wearing, what kind of gun he had, etc.
This is kind of a text book example of that.
Oh, and that DA seems to be a very reasonable guy. Handling this well.
