That's not an argument for self-defense. Just holding a gun is NOT a clear intent to kill "no matter what".
Until the gun was pointed towards him there isn't an argument that his life was in danger.

The shooter is definitely a murderer. But I am not throwing hands with anybody. Too many bad outcomes can come from that. If someone attacks me, they’re getting shot. I have a family to care for and I can’t risk being knocked out or having permanent damage to “throw hands.”
