N.J. can use ‘drug recognition experts’ to determine if you’re high

In a report expected to have a big impact on how New Jersey determines who is high on the job as well as a legal challenge to state rules on impaired driving, a court-appointed special master has concluded the testimony of so-called Drug Recognition Experts can be admitted as reliable evidence in such cases.
Under the state’s new cannabis law, employers can still conduct random and pre-employment drug tests for weed use and can still ban marijuana use at work. They cannot fire, discipline or refuse to hire someone solely because the result is positive.
To enforce their rules, employers must have their own experts called Workplace Impairment Recognition Experts, or WIREs, witness impaired behavior by an employee and a positive drug test indicating presence of marijuana in a person’s system.
This is because weed stays in your system for a long time so if you test positive it doesn't mean you're high but this drug recognition expert stuff seems fishy to me and probably pseudoscience.
The article says the training they receive is comparable to what medical technicians go through which doesn't inspire confidence but it's a growth field if somebody in NJ is looking for a career.

Yeah, you're going to have to have a quantitative test for this
Posted on 8/19/22 at 5:34 pm to Diseasefreeforall
Takes one to know one

Does the test involve Funyuns or Taco Bell?

You can test to see if someone is actively metabolizing cannabinoids, nobody is going to pay for that testing though!
This Expert witness sounds like a bunch of bull shite.

well just like alcohol, you can have it in your system and not be impaired by it, but a drug test just shows you took it in the last 30 days and that is why drug tests are useless BS that should be unconstitutional for that reason. they dont show anything about you about whether or not you use or are high at work.
i could see and go along with something like a dui test, where you walk the line, check pupil reactions, say the alphabet or count backwards, and such, to see if you are impaired or not

Nothing sketchy to see here.
Solution, go to interview high, go to work high, ergo... your baseline is High... and you are free to party how you want.

Suspect: this sucks
Expert: not weed

The news did a piece on cobb county deputies doing this years ago.

And the Workplace Impairment Recognition Experts probably feel like they've gotta bag some stoners to justify their jobs.

i literally know a guy like that, he likes weed and never went a day not being high, it was his normal baseline as you say. the more high he was the more straight and rational he was, when he wasnt high and was forced to be straight, he seems drunk and unable to function properly.
we used to joke about it saying his body cant function if he wasnt high and it was true

FYI, LSP has this already

The nystagmus (pen) test is bullshite, too, thanks to how cops naturally abuse it. Should not be allowed in court.

They're probably just as good as the dogs, which shouldn't be used, either.

Ugh... marijuana drug tests normally test for a metabolite thc breake down into. Metabolite isn't gonna get you high, regardless of quantity. In that manner it's nothing like alcohol. Testing for active thc isn't nearly as easy, or non invasive as peeing or breathing into something.

You can pass all of these with flying colors and still get a dui based on blood, breathe, or urine results.

Put them in a room with a bunch of snacks. Observe. It's at least a better system than we have now.
Realistically until something federal happens it won't have a big impact. DOT is the biggest issue.

I guess it’s if it’s a twofer and not abused.
People used to think I was stoned before I had ever even tried it. So I guess then if I was accused I’d still pass the piss test.

Weed does have some physical affects on you. Just like alcohol.
