I hope they add to not reach for the gun in your pocket and to not fight back when the police try to arrest you.

quote:

A bill that would require first-time drivers to take lessons on how to act during a traffic stop could soon be on its way to the governor’s desk in Louisiana.

The proposal passed the state house on Sunday with a 96-0 vote and previously passed in the state senate last month with a 36-0 vote. Since the bill has no added amendments from the house, no further action is required in the senate and the bill is expected to move to the governor’s desk.

quote:

First-time drivers would be required to take a training course to learn the “appropriate way to respond when stopped by a law enforcement officer,” as described in the text of the legislation. The new law is an addition to the driver’s license requirements already on the books.

“There’s a plethora of training on the officers side of the equation, but what we’ve found out is there’s no training [for citizens] or very little if any,” Gatti added. “If there is training it’s different in every parish. This will make the training uniform and officers will be aware of the training given to the drivers.”

On a side note, the bill's author has a brother that is in Angola for life for shooting a police officer. Kind of ironic.

Common sense isn't as common as you would hope in this state:

Are they going to specify what rights the driver has? Right of refusal of search without a warrant, right to film detention/stop, right to refuse breathalyzer etc?

I doubt it .

It really boils down to a combination of respect and kissing arse. It's a fricking tough pill to swallow sometimes. But I'm usually carrying weed, so I'm? just try to get out of there asap.

I am constantly amazed by how useless the Louisiana Legislature is.

Any state going out of their way to inform their citizen's of their rights of laughable. But Louisiana? That's the funniest shite I've heard in awhile.

That's common sense. Still isn't going to help you if there is probable cause.

This is a GREAT idea. All schools should also have a class one day a year from 7th-12th grades on how to interact with police.

The famously ineffective New York State legislature, which is the butt of jokes on 1776, would be better just because they are too useless to actively frick in things.

Ours OTOH manages to regularly come to agreements just to frick us.

Maricopa County, yes the same one Sheriff Joe was in charge of forever, has always let people know their rights. You can see it on their website HERE if you don't believe where I got what is pasted below:

The Police Can Lie to You
Police can lie to you to try to get you to talk. For example, they can say that they have videotape or fingerprints that they do not really have. Also, police can tell you that someone else told them things, even if that is not true.

Police can say that they will not press charges if you talk, but the police are never the ones who press charges. The people who press charges are lawyers called county attorneys who prosecute cases in court. County attorneys can press charges even when police promise not to.

Talking Does Not Reduce Chances of Jail Time
Talking to police will not lower the chances of going to jail. Usually, police have already decided about taking someone to jail before even trying to talk to him. In fact, there have been times when police were not going to take someone to jail, but after the person talked to police, the person ended up being taken to jail.

Ignorance of the Law is No Excuse
Talking to police is very risky. You might say something without knowing that it hurts you. For example, not knowing that something is against the law is not an excuse. Also, sometimes police record it when they talk to you, but sometimes they do not. Police write summaries of what you say, and they may leave out what is most important to you.

Consult Legal Counsel First
If you are thinking about talking to the police, talk privately with a lawyer first. If you cannot afford a lawyer, a lawyer will be given to you. This is because you have the right to have a lawyer. You have the right to have a lawyer with you if you decide to talk to police. You also have the right to have your parents with you.

I guess my question is if they aren't going to spell out these things what exactly are they going to tell the driver to do in this law? Just follow the officers EVERY query, order, and request? That's every officer's wet dream. Imagine a society where the citizens are told they have no rights .

Are you suppose to get out of your car and meet the cop or stay in your car?

You are supposed to wait in the car and then do what he says. If he wants you to come back, he will let you know. One thing is for damn sure, don't come barreling out of the car the second you get stopped and head towards them. That never works out.

If you don't know that then that is your fault for being an ignorant citizen.

right to film detention/stop

I would wager to say 90% of police agencies use video already.

quote:

right to refuse breathalyzer

You're literally told this right before the test is offered.
