This and even if you pass/blow 0.00 they will call out the DRE guy who took an 8 hour class. When the DRE sees that you have a pulse, are breathing, eyes are moving, and maybe have sweaty palms you will be arrested.

Whether dead drunk or stone sober, no one should ever take the Standard Field Sobriety test, ever. It's very rarely conducted properly, and even when it is, it's barely better than voodoo.

I was married to a criminal defense lawyer for 20 years, and family in law firm.

They are NOT confirming you are sober....they are collecting evidence.

Understand, a cop will not remain employed, if he writes no tickets or makes no arrests....let that sink in

Rsowell police are real bad about this. I can remember someone posting a video on here a while back about one Roswell officer handing out a record number of DUI's many of which were to drivers who were not impaired. There should be big time repercussions for officers who do such as one DUI can ruin a person's life/career depending on what they do for a living.

On a date in high school. Went to a movie and had a pre-movie beer. (legal age was 18 at the time)
On the way home on a rural 2 lane road I was "talking" with my hands and hit the steering wheel which made me cross the yellow line.
Deputy pulled me over. Asked if had been drinking. Told him the truth.
Made my date drive home. The end.

the real crime was taking a date to see "Dr Detroit" ( I think)

Make them verbalize what actions are expected crimes are they accusing you of...and of course, that you dont consent to any type of search.
Short, clear words

It matters in the end. If they are getting you out, they ABSOLUTELY want to arrest you, but can't whike they have nothing, and your sitting in a car.
At minimum, they'd have to say something like "we smell alcohol "...which, in this case here, the breathalyzer showed zero, and he would have been cleared....because obviously they lied saying they smelled it. (just an example, not 100% true in all circumstances)

No matter what happens, the less you say, other than specific necessity, the better you are in court being defended.

Twice in over twenty years, but one was for speeding on the interstate. The other was just because of the type of car I was driving, I guess. Did nothing wrong.

My roommate in law school was a retired FL state trooper. His advice (though I think GPT's answer above is better) paraphrased:

Ask him "are you asking me to get out or are you telling me to get out?" At that point a decision has to be made about how much paperwork this guy wants to get into tonight.

You must get out. If you don’t get out, you’ll catch a resisting or obstructing charge to go along with your other problems.
