personal liability of a fiduciary under ERISA
[/i]
quote:f the non-payment of premiums).
ERISA expressly contemplates that an officer, employee or other representative of a company may also serve as a fiduciary of a plan. ERISA §408(c) (3); 29 U.S.C. §1108 (c)(3). Because of the obvious risks arising from their dual-capacity status, fiduciaries are expressly prohibited from dealing with the plan assets for their own advantage and from acting on behalf of a party whose interests are adverse to the participants. ERISA §406(b); 29 U.S.C. §1106(b). A fiduciary who does not pay contributions to a 401(k) plan or health insurance claims in order to pay the company's other creditors may be dealing with plan assets for his own account (i.e., his investment in the company) and/or acting on behalf of the interests of the company when its interests are adverse to those of the participants (i.e., they both want the same money). The fiduciary may also be construed to be loaning plan assets to the company, which is expressly prohibited. ERISA §406(a); 29 U.S.C. §§1106(b). See, also, IRC §4975(c). Included in the duty to act in the best interests of the plan participants is a duty to inform participants of material information regarding their benefits. See Griggs v. E.I. DuPont de Nemours & Co., 237 F.3d 371, 380 (4th Cir. 2001). This duty obviously includes a duty to inform participants of circumstances that threaten their interests in a plan. Mira v. Nuclear Measurements Corp., 107 F.3d 466, 472 (7th Cir. 1997) [b](holding that the company and its officers breached their fiduciary duties by failing to advise employees in a fully insured health plan that their insurance coverage had lapsed because of the non-payment of premiums)b](holding that the company and its officers breached their fiduciary duties by failing to advise employees in a fully insured health plan that their insurance coverage had lapsed because o

Yep. ERISA is going to take all his toys from him.
He may think he’s teflon but his days are numbered. He better live it now because even if he doesn’t go to jail he’ll be broke
. And that’s only the health insurance side of if-not the PPP which will surely put him in the jug.

Has Sills surfaced anywhere in BR since this went public
I imagine he would be heckled pretty hilariously.
People would love for a POS his size to respond with anything so he could catch an arse whipping.

Only this latest employee has sued. No one else has. The problem is he has no money. All the money he is living on is borrowed PPP and this new Main Street Program loan SBA. Trust me we shopped around for attorneys and they ran from us no one wants to deal with Kelly and all his lies and shenanigans. Serving him alone is a painstaking process. Ultimately I believe the government through FBI and DOL will take what money is there and then put him in the jug.

Those Xmas party videos are great. So much awkwardness.

Replying so that I don't have to spend as much time searching for where I left off next time I remember this thread exists.

Probably at the river house hanging out with Landon Collins.

No clue not involved in that. Hopefully it will work out best for everyone.
But hey look at this post from the latest article on kelly and our employees unpaid medical. It was posted by a woman whose husband still works for Kelly. Delusional or what! She obviously can't handle the truth!
Anne-Marie Fasullo Williams posts:
Wooooow amazing all the judging going on for a report that is working to persuade the public against a man, father, human being who is working to get back on track.
Just remember
Anything taken out of context can lead you to believe something false and that can grow to a completely incorrect story that is getting ratings and attention. I’m going to wait for the whole truth to come out and then let’s read some comments.
Judge all you want but one day this could be you. Think how your family will feel. Children parents and friends. This world has become so hateful it’s sad.
For the record. I don’t care who disagrees with me or wants to start crap over my opinion. At least my opinion comes from speaking to him first hand and not media persuasion.

Not only does her husband work(ed) for coastal, she's a certified head case. One of those 'bar rat, hanger ons' that would've licked Sills' boots back in the day - of course she would defend him. Would take her opinion with a grain of salt. And she loses all credibility with the

How about the employees or companies getting shafted by him ... ironic she should use those words in his defense

Well speaking to him first hand I would question is that before or after he does a line of coke ? In my past dealings with him after he’s sends he’s bible verses and emoji text in the mornings . He would do a hit or whatever of cocaine mixed with god only knows what . Then would go off the deep end cussing screaming and by that afternoon not remember a thing he said or did!

I just wish Kelly would have the balls to give a interview with Nakamoto. TV ratings would be awesome from Baton Rouge to Dallas.
