Depends on his mood, but definitely unacceptable to accept a trip knowing you need gas.

How far was your ride?
If less than 5 miles, then he was low enough that he should have grabbed gas beforehand.
A lot of rides are less than 5 miles, so you can usually guess you have enough gas until a natural lull and don’t need to miss a ride.
I once drove someone to BR from MSY. I had to stop for gas because I didn’t anticipate driving nonstop for over an hour.

The driver might have got in his car then while close to picking yall up realized he was out of gas. Stopped and filled up because he didn't want to risk running out. And it's not their fault you are a shitty planner. I would think you would plan to arrive 10-15 mins earlier than you are suppose to be there anyway.. Because things happen, that could cause you to be a little late...

Dude, sometime a trip comes up when he was about to get some gas and was running on fumes. Don’t tip, but give him a break on the rating.
