They are a crock of shite. It’s a money grab is all it is. As mentioned you can be arrested and still held regudless if the reading. According to the Law and courts, you are “impaired” at 0.1-0.2 and can be prevented from driving. They can also hold you on suspicion of drugs if you don’t blow any thing.
Also just an FYI, you can and will be charged with a DUI if you are driving a boat, golf cart, UTV, bike, lawn mower and horse. It will be tied to your drivers liscense, insurance and carries the same fines, punishment etc as if you are driving a motor vehicle.

My neighbor cop is a gear head with a highly modified later model Camaro. He is not subtle at all and his car has a loud exhaust so he dgaf. Sad cause there are small children that live at almost every other house on the street. He took off so fast the other day I was surprised he did not lose traction and go in someones yard.

I don't see why this conversation is still continuing at a .01 he immediately got released out of jail and let go no charges were administered the threshold is .08

the problem with our system is, you can be arrested for a DUI just based on the opinion of the cop, you could blow a 0.00, and still be charged, sad thing is, although OP will not end up being convicted, he will have all of the hassle and expense as if he were convicted, including, jacked up insurance rates

I don’t understand how the police can get reliable results from that eye test when they are usually shining a flashlight at or near your eyes while administering the test.
The smell of alcohol? I thought that alcohol was more or less odorless. A policeman should be able to identify the type of spirit by its distinctive odor.
A friend took a field sobriety test one night in Mandeville. The trooper who stopped us was demonstrating how to do the field/toe test, slipped off the edge of the bad road, and fell down. I guess the trooper was impaired. In his defense, the trooper didn’t charge the driver with anything but did make him call his dad to pick us up. This was back when you could drink at 18 while in high school.

Also, I have a lazy eye due to optic nerve hypoplasia for everyone saying that he saw nystagmus. And I told him repeadetly that I had a lazy eye that would make my eyes jump.

Actually. If you refuse a breathalyzer, reguardless of the reason it’s being administered and what you ultimately get charged with, you will immediately loose your liscense for 1 year from that date. If you blow and it’s higher that 0.8, you loose your liscence for 90 days, 30 days after you submit on 1st offense. Not sure what the time is after the 1st. Also with a refusal, if you are in a non refusal Parrish, they will get a warrant and draw blood. Regardless of the outcome of that test, you will still still lose your liscense for the year. The DMV and the courts are separate on this. You could be released from jail after the blood test comes back all clear but your liscense is still gone for the refusal.
You can appeal the suspension with the DMV but the only way they are going to drop this is if the cop screwed up the paper work or it can be proven the cop did no have probable cause to stop you. And even if all of that is true, you are still out 3-4K to have a lawyer do all that.

Sure thing, as soon as you install video equipment in every car that can monitor a driver on his phone. I guarantee those frickers cause more accidents than drunk drivers, and the punishments are faaaaar from equal.

Lol. Want to hear something even more funny? Every Parrish and sentence is different on what the court decides on DWIs, however the one thing consistent in LA is the loss of a Liscense for failure/ submitting above a legal limit. While suspended, you can apply for a “hardship” lisc that will allow you to drive to and from work while serving the suspension. On top of the heavy monthly cost for this Liscense, you also have to pay to instal and monthly maintenance for a interlock system in the vehicle you are to drive. The breathalyzers now come with video and GPS, monitoring, as well as go off every 2-22 min while driving tht you have to submit while driving in addition to the one to start the vehicle.
The irony of it to me is you can’t even hold your phone while driving but lawmakers make this a requirement. Distracted driving is distracted driving. Regardless if you are texting/reading/ talking while driving, or blowing into a box. I’m sure the initial and monthly cost that the offender is paying each month has nothing to do with it.

I one had a friend who is a cop tell me to keep a small unopened bottle of booze in the pocket on my door panel. If you get pulled over and you have been drinking, pull that bottle out, open it and chug it. No way for them to prove you were drinking prior to getting pulled over.

I was pulled over for my tint after drinking 4 beers with some friends. Refused to blow. case was dropped less that a week later. But in Florida you STILL lose your license for a year. frick you, whoever is the cause for this.
The officer wrote that I ran up onto a sidewalk and rode my truck down a sidewalk on a 4 lane road. A senseless lie trying to ruin my life and I hope the man dies.
I know how dumb it was, but I drove on my suspended license for the full year. For a full year I avoided letting police officers get behind me with professional level efficiency.
I just couldn't stomach giving these fricks more money. Again, frick everyone responsible for this.

It was pretty scary at first but became second nature. I felt like as long as I could keep an officer from being stopped behind me at a light, I'd be fine.
I became hyper sensitive to where any cop was around me and where I could easily make a right turn into another road or parking lot.

Not a cop but I do work in a law profession. Let me tell you, there are WAYYYYYY more dumbass "lawyers" in this state who passed the bar by the skin of their teeth then there are a-hole cops. That makes this thread even better when 85% of the responses are "I'll talk to my lawyer about the mean cop".
