Good point. Cops shouldn't have to use siren and lights and should be able to blow through red lights at ridiculous speeds.

Idiot.

And fwiw, it's not illegal to drink and drive. It's illegal to drive impaired. Big difference.

I got pulled over by a cop on a local hwy that was driving like 1/4 mile ahead of me. Early sunday morning so road was empty. He was in an unmarked 4door black tahoe

Anyway, i asked how he clocked me if he was driving, and he said he had a doppler "like" radar system in his veh that can judge from behind. I go "like the weather?", not like a smartass but confused by the response. He just gave me a smug look, and gave me my ticket.

I attested the ticket b/c I thought that doppler thing was crap. No one I asked had ever heard of it. Even a few cops I asked. I asked him in front of the judge about it, and he said he didnt say it. I told the judge he was lying. Judge made me pay.

Long story short, I appreciate what cops do to put themselves in harms ways, but never trust one (or a judge) when they are looking at you as a potential suspect for something. Unless you are some hot chick. Ha. Treat them with respect, but record. Heck I remember my dad installing a radio in his commute car that had an ability to record. He wired it for the mic to be just above the driver side window.

My cousin was killed by a drunk driver. That does not change the fact that DWI laws are draconian bullshite laws designed to generate revenue that are allowed to continue to exist because the people with a vested interest in the money generated continually play on the emotions of the simple minded to keep the laws intact.

ask to see the radar gun next time. They don't have to show it to you, but it looks good when going to court, and they can be asked to show the logs at court. In addition, you can also ask for callibration records for the gun. If they can't show callibration, you can reasonably argue that the radar gun is inaccurate and not precise.

DMV had made an error and had my license suspended. Went to argue in court. Could not prove anything yet so I said I would pay $1000 ticket. (Said it angrily) Judge said got sit it room. Baliff comes in after an hour and hauls me and others in room off to jail for mandatory 10 days. I hired an attorney for $4K and he got me out after 4 days. Almost got fired from work. I went to DMV and they "Apologized" for the error and my record was expunged. Could I have sued anyone? Never really crossed my mind at the time. I was too busy working.

I agree 100%. No reasonable person wants drivers on the road who are smashed and pose a risk to others but it’s absurd that you can essentially drink a couple glasses of wine at dinner with your girl or throw back a couple beers with your buddies and then go to jail for it.

Reading threads like these, it truly astounds me that people do not understand the nature of cops during a traffic stop.

They are not interviewing you for information in another crime. They think YOU are the criminal. They are interrogating you, and they will use every tool in their bag to conclude that you have committed a crime, whether or not they think you have actually done so. Partly because of revenue, but mostly because if they thought you weren't drunk and let you go, but then you killed someone later, they would have hell to pay. Therefore, everyone is assumed drunk if you show even the slightest sign of it.

The fifth amendment is your best weapon to counter this situation, and it amazes me how people just don't use it.

I agree with your rant (ha), but how does someone use the 5th when laws have been created to screw you over still somehow when you do? For goodness sake we are letting (by force) blood to be drawn w/o consent.

Get an attorney. If you blew under the legal limit, the officer is going to make a DWI LESS SAFE case. A decent attorney should be able to get the case tossed or reduced to lesser charges.
