I did a brief google search on the law and I think it's too late for him. He signed an Affidavit acknowledging his own paternity when the child was born. Under La. law that's the only way for you to sign the birth certificate. Now that the child is a few years old it's too late for him to contest paternity. He is the legal obligor that the La. Dept of Child Support Enforcement will go after for child support, no matter whether Mom lives with him or not.

That sounds roughly right. But you need to see a lawyer who is actually current on Louisiana law, assuming you are in Louisiana.

You'd better double check the law on Child Support before you conclude it's over. Your romance may be over but I think you may be liable to pay child support for that child because you signed an Affidavit swearing that you are that child's biological father. La. law, I think, required you to do that before you were allowed to sign the birth certificate.

So this might be a long way from being over.

That was my understanding as well based on what I've heard from one of my patients who went through something similar. She very likely has him by the balls, hopefully she doesn't squeeze and twist...

A friend in New Orleans had legally separated from his wife. She was living with another man. She got knocked up by other man. She gave birth. Judge in divorce proceeding didn't care that our friend hadn't signed the birth certificate or that they had lived apart for several years. Our friend got stuck with child support.

His obituary said he was survived by his two children (names listed) and by (name of child of his wife.)

We really have to literally start tarring and feathering judges like this and ban them from ever practicing law of any kind going forward
