To be fair we don't know that at all. We're assuming that since Gasser was released, but we don't know what thresholds were hit for the self defense claim to be valid.

We know the 3 shots were fired from inside the vehicle.

Except that was a cop attempting to make an arrest. This is an armed citizen shooting a guy in the street at 2:30 in the afternoon. Big difference. They better have some pretty clear evidence to release the guy this soon.

Innocent until proven guilty. I'd hate to think the cops needed clear evidence to not arrest me rather than arrest me.

It will be interesting if any video is found showing if there was any another confrontations prior to the this one at Behrman Hwy and Holmes Blvd. Since it started on the GNO bridge there are many lights and many businesses before getting to this intersection.

Evidence indicates JM physically threatened another human

None of this evidence exists at this point.

1) JM was the only one out of the car, shooter stayed seated

2) JM had illegally pulled along beside the shooters car

3) JM had pushed in the guys passenger side mirror

4) Passenger window was rolled down

5) Shots were fired from inside the car

. . . . All signs point to JM being VERY angry. Its not a leap to say a beefed-up football player appeared to be threatening

He's not in a traffic lane.

Well, then:

quote:

§296. Stopping, parking, or standing upon the highway shoulder; driving upon the highway shoulder

A. No person shall stop, park, or leave standing any unattended vehicle on any state highway shoulder, unless such stopping, parking, or standing is made necessary by an emergency,

Whipped his scrotum, his legs, his back and his hands. There's pictures online. It's not just a belt on the kids butt.

I agree he went overboard by today's standards and farther than I ever would with my kids. Just don't feel like he deserves to be lumped in with the others.
