Ironically, one of the guys our former Governor pardoned headed out the door was in a situation like this. He was the trigger man but the three were charged and convicted of murder in a home burglary.

Yea this happens pretty frequently. 2 or 3 hoods rob someone and one person shoots the victim. All 3 get charged with murder. This isn't out of the ordinary at all.

A person also commits the offense of murder when, in the commission of a felony, he causes the death of another human being irrespective of malice.

Felony murder and accomplice liability are two monstrous doctrines imo. Sending someone to prison, potentially for life, when said person didn't commit the act that proximately caused death and had no intent for death to occur, is extremely problematic.

It is when you are a civilian and you dont have the grounds for knowing it is a felony or the legal right to pursue / attempt to perform a citizens arrest.

Prosecutorial overreaching. Felony murder is often an absurd doctrine that is invoked to justify draconian and disproportionate charges.

That is textbook felony murder.

Even further, the three guys break into the house and the homeowner kills one in self-defense, the other two are technically guilty of felony murder of the third.

Yep.

There was a case just last year in Alabama where a kid got sentenced to 65 years for the murder of one of his partners in crime after the cops shot and killed him.

Absolutely not, but all 3 would be charged, tried and convicted of murder here in SC based on common law accomplice liability (hand of one is the hand of all). Criminal defense advocates have been railing against these doctrines for years, with virtually zero support from the public.

They never laid their hands on him. Arbery made the first physical contact when he lurched towards the gun. Not sure how you can claim false imprisonment.

If trailing behind a guy in a truck is “felony attempted false imprisonment”, then that shite happens anytime someone in a vehicle follows someone who pisses them off in traffic.

Do people who tail someone who pisses them off in traffic call up a couple buddies to intercept and box in the person you're tailing, guns drawn?

Your takes get worse by the post.
