Legal question about the Florida Disney world tragedy

Will Disney offer some type of settlement to the family? If not, would you sue Disney? I know it won't get their son back and this is just an awful situation, but I'm just getting everyone's opinion

I'd like to think I wouldn't sue just because my heart was ripped out.

The amount won't be disclosed as part of the deal....I'm guessing 100m dollars.

only after they are sued and are about to get skull fricked in court will they offer the family a huge settlement. Obviously no less than 25-30% going to attorneys and shite.

I wonder how many attorneys will soon approach them though to represent them in a lawsuit.

I would expect a substantial settlement to occur, however there is not enough money in the world to erase the trauma and emotional scarring that father will have the rest of his life by watching his kid get dragged away by alligator.

It'll be around $50-75 mill. More than enough to not insult family, semi-restore their PR and then some.

I cannot fathom being the parent of that sweet child. That said, I'm not saying they'd be wrong to sue and I'm not saying that Disney would be wrong to settle BUT is it Disney's "fault"?
Could/should there have been more signs? Sure.
Would that have kept the child out? I would doubt it.
Again, I'm not emotionally tied to this and cannot say or even think about how I'd feel if it was my child.

I'd like to tell myself that I would sue and donate the money to charity. Obviously I have no idea how I would respond in that situation.
However, the family should sue if there is a legitimate case against Disney. Suing is not always about financial rewards for the victims. It's also about punishment for the guilty and making sure it doesn't happen again.

family should have zero emotional distress about the monies they receive. Make their other child want for nothing and try their best to find peace in life with no financial troubles.

I agree that I don't think the family is thinking about a lawsuit right at this moment. They are going through immeasurable pain and shock and having to wait for an autopsy to be performed before they can take their baby home for burial.
The one thing I would want from Disney is action on more reasonable signage. That alone would cause me to file a suit unless I could get that agreement without having to file.
I don't know how financially stable this family is, but in addition to costs of shipping their son home and burial, they will all likely need counseling. I would want counseling for the 4 year old right away, as well. I don't know how much she saw, but just knowing a gator took her brother could be pretty darn traumatic. The parents could have all manner of problems and PTSD. Once the dust settled, these things would be of great concern to me if I could not financially afford them. While money will not bring that precious baby back, this event triggered devastation which may be expensive to treat and I would feel I have an obligation to ensure that I could take care of my family and myself as far as mental and emotional issues now and in the future. It's hard enough to lose a child in any manner, but these events are horrid.
I think if a claim is made, Disney will settle regardless of the legalities of the situation.It doesn't need anymore attention to this than it already has. I'm sure they are praying for some other story to take over the headlines.

I would assume the key would be what was reasonable under the totality of the circumstances and facts. It's not really your typical FL gator story. I'm guessing, though.
