In 2000, a family reached settlement when a person was killed when a ride malfunctioned. Settlement was estimated to be $20 million.

Now I'm not saying one death is worse than another death, but this is a nightmare scenario for Disney. A 2 year old was killed in a horrible way by animals they knew lived in the waters they encouraged kids to play around.

They'll pay a very large amount to this family.

I agree, but unless there is some reckless indifference, or something else that would make it rise to the level of corporate punitive conduct, the settlement value is IMO not over $20 million. Jury valuation is a different analysis

they would go to court and if an award was given that large the judge would reduce it.

Well the gator is a wild animal...so none.

I'd say 80% on Disney; 20% on the family.

What's going to piss me off is when other familes that were there try to sue Disney for "knowingly putting them in harms way" or having to witness something so traumatic.

That seems a bit much and I don't see how anyone trying to do that could be successful.


And DW has been comping everyone staying at the Grand Floridian when this happened. I read they were paying half a million a day in comped hotel fees.

There is a common law rule that prohibits that type of case in Florida.

I wonder what the response would have been if the kid/family was Spanish and possibly wouldn't have been able to read any signs...

Considering it is Florida I would imagine many of the signs in the park are already in English and Spanish.

ETA: And I'm assuming you meant the family spoke Spanish right? Or did you mean they were from Spain?

Any language for the point in trying to make. Disney has lots of people from Brazil so Portuguese. Or Chinese. How are they "warned of hazards"?

Pictures would meet the legal requirement for notice under Florida law. They have pictures of gators at other resorts on their warning signs just not where they had this beach at this property. But then again that's completely irrelevant here.
