i don't see why it can't be both. hate crime and habitual offender.

I believe they went that way bc conviction on battery was all that was needed to put this guy away for life. Easier to convict for battery only, rather than both and opening up another avenue for appeals. Just a guess though.

Let me make this as clear as possible. They had to get a felony conviction for the guy to get life. The Second Degree Battery charge, a felony, was simple to prove. He beat the guy so bad he put him in the hospital. Boom. Life sentence.
But if you charge the Hate Crime now you have to drag race and intent and a bunch of other elements into the charge. Likely you will not “prove” one of those points to one of the jurors or you may just flat piss off someone on the jury with the racial angle. Boom. No conviction and guy walks free.
THERE WAS ZERO REASON to risk him going free by charging the Hate Crime.

I said it because he is a piece of shite with a clear-cut violent history. He did more than his part to make North BR a shitty place to live and be. I don't have an ounce of sympathy for him, and in fact- wish all the bad things prison can bring down upon him. Is that clear enough?
As for your last question- you are clearly showing a sympathetic eye because of what his race happens to be- which is lame. But that's on you- not me.

I agree. There's a time to be an idealist and a time to be a pragmatist. Putting someone behind bars for life I'll choose to be a pragmatist.
Now, the idealist should take this case before the legislature and ask, "If this isn't a hate crime, nothing is" and throw out that unconstitutional statute.
