LA Supreme Court upholds life sentence for "wrong neighborhood" thug

I think it is important to remember that many OT Posters bashed Hillar Moore and the DA's office when they didn't charge a "Hate Crime" in this case. They explained at the time that the guy would get a LONGER sentence (life) as a Habitual Offender and that the conviction would be more likely as Second Degree Battery instead of a hate crime statute. Glad to see this guy will never walk amongst us again.

The Advocate reports he has prior convictions for armed robbery, simple robbery and purse snatching. Dickerson claims his conduct did not amount to second-degree battery and his sentence is unconstitutionally excessive.
An appeals court disagreed, and the Louisiana Supreme Court on Friday let that ruling stand.

This sentence is wrong.
He should have been sentenced to swim across the Mississippi River. If he makes it across alive, he is allowed to go and live free.

The hate crime statute in LA is a sentencing addendum but the DA chose not to charge it simply because it wasn't necessary and you run the very real chance of sparking jury nullification and/or just giving him something else to appeal. But that didn't stop the keyboard pundits from howling about the decision not to charge it.

C. If the underlying offense named in Subsection A of this Section is a felony, and the victim of the offense listed in Subsection A of this Section is selected in the manner proscribed by that Subsection, the offender may be fined not more than five thousand dollars or imprisoned with or without hard labor for not more than five years, or both. This sentence shall run consecutively to the sentence for the underlying offense.

Which it clearly was. At least he's getting life.
Hell will freeze over before a black person is charged with a hate crime against any other race, particularly a white person.

So what? I asked why this wasn't a hate crime? At the same time someone else explained, and it made sense. What does that have to do with when it happened
