I think it is important to remember that many OT Posters bashed Hillar Moore and the DA's office when they didn't charge a "Hate Crime" in this case. They explained at the time that the guy would get a LONGER sentence (life) as a Habitual Offender and that the conviction would be more likely as Second Degree Battery instead of a hate crime statute. Glad to see this guy will never walk amongst us again.

quote:

The Louisiana Supreme Court has upheld a life prison term for a man convicted of severely beating another man at a convenience store five years ago after telling the victim he was in the "wrong neighborhood."

Donald Ray Dickerson, of Baton Rouge, was found guilty in 2015 of second-degree battery in the attack on David Ray III, of St. Francisville. Ray was hospitalized with a broken eye socket, broken nose, and other injuries. Dickerson was sentenced to life behind bars, deemed a habitual offender. The Advocate reports he has prior convictions for armed robbery, simple robbery and purse snatching. Dickerson claims his conduct did not amount to second-degree battery and his sentence is unconstitutionally excessive.

An appeals court disagreed, and the Louisiana Supreme Court on Friday let that ruling stand.

I’m not defending this guy’s actions but the white guy was in the wrong neighborhood.

Good news. The only problem is that he'll be happy hanging with his ilk on the tax payers dollar.

This sentence is wrong.

He should have been sentenced to swim across the Mississippi River. If he makes it across alive, he is allowed to go and live free.

In New Era, LA.

The hate crime statute in LA is a sentencing addendum but the DA chose not to charge it simply because it wasn't necessary and you run the very real chance of sparking jury nullification and/or just giving him something else to appeal. But that didn't stop the keyboard pundits from howling about the decision not to charge it.

quote:

§107.2. Hate crimes

A. It shall be unlawful for any person to select the victim of the following offenses against person and property because of actual or perceived race, age, gender, religion, color, creed, disability, sexual orientation, national origin, or ancestry of that person or the owner or occupant of that property or because of actual or perceived membership or service in, or employment with, an organization, or because of actual or perceived employment as a law enforcement officer, firefighter, or emergency medical services personnel: first or second degree murder; manslaughter; battery; aggravated battery; second degree battery; aggravated assault with a firearm; terrorizing; mingling harmful substances; simple or third degree rape, forcible or second degree rape, or aggravated or first degree rape; sexual battery, second degree sexual battery; oral sexual battery; carnal knowledge of a juvenile; indecent behavior with juveniles; molestation of a juvenile or a person with a physical or mental disability; simple, second degree, or aggravated kidnapping; simple or aggravated arson; communicating of false information of planned arson; simple or aggravated criminal damage to property; contamination of water supplies; simple or aggravated burglary; criminal trespass; simple, first degree, or armed robbery; purse snatching; extortion; theft; desecration of graves; institutional vandalism; or assault by drive-by shooting.

C. If the underlying offense named in Subsection A of this Section is a felony, and the victim of the offense listed in Subsection A of this Section is selected in the manner proscribed by that Subsection, the offender may be fined not more than five thousand dollars or imprisoned with or without hard labor for not more than five years, or both. This sentence shall run consecutively to the sentence for the underlying offense.

Which it clearly was. At least he's getting life.

Hell will freeze over before a black person is charged with a hate crime against any other race, particularly a white person.

So what? I asked why this wasn't a hate crime? At the same time someone else explained, and it made sense. What does that have to do with when it happened
