LA Attorneys: why don't we have e-file?

E-file would be efficient and cost-effective. Louisiana doesn't do efficient and cost-effective things.

That's insanity.

I get mad when i have to mail discovery instead of emailing it (You can email by agreement, but you don't file with the court, so the statutory method is still snail mail and tree killing, not that i care about the latter really--i just hate printers and postage when totally unnecessary.)

However, in GA, the state courts use third-party services (and require efile for most stuff), which charge for everything. E.g., $5.00 plus a service fee and a credit card fee (which you have to use) to file a certificate of service of discovery.

No one complains because it's beans in the grand scheme, but it is indeed a SCHEME nonetheless.

I’ve practiced in La and Tx. In Tx, efile is efficient and discovery is sent via email. No need for a runner. Filing in Texas is cheaper too.

La is slowly getting there, piecemeal though. Until there’s a statewide mandate it’ll be shitty. Don’t expect the CDC one to be efficient or simple.

The worst is Orleans Crim Court. Not only is there no efile, but you still have to file motions in open court and get a hearing date set right there. One Judge if I recall wants like four copies filed with the clerk then three copies delivered to her in open court or some Byzantine bullshite.

it's proof that we have too many clerks, courts, and political divisions

I don't mess around much in state courts, but I know a few counties here have been on e-file a while, and it looks like the State is on a uniform system rollout now.

I'd bet you there are some old dogs in backwater areas in all states that don't have copiers that scan to PDF. So, they probably could not e-file. To this day, I still see a few people on the Mich bar website that don't have email addys. Who the F is faxing these days?

There are 64 parishes and 42 judicial districts. Many of those areas are very rural. The Louisiana Supreme Court will have to mandate it, but I can't imagine that will happen until there is a standard program or system that the Clerks can acquire to set it up.

I was just talking about this the other day. It's absolutely absurd how much of my stuff Orleans CDC loses on a regular basis. The kicker: "oh just refile it, and send a new check".

Only other option is to go hire a runner to make sure it's done correctly.
