I think it would hamstring the prosecution if their new trial is confined to the charges he was found guilty of, while the defense is bolstered with evidence he was rightfully in self-defense for at least some parts.

The judge is going to admit the high res tape to the jury. It would be fricking hilarious if BLM went more for Binger and that fat arse more than the others.

Then it wouldn't be a mistrial... unless the judge declares it a mistrial and I would think if it comes from the bench it would apply to all charges.

I'll provide another view. I think he may let this go to a hung jury and then rule on the motion for mistrial with prejudice. There's no way you can find another jury who is completely impartial without an opinion on this trial.

As I stated dozens of pages ago, I have a doctor who is from the same area and is about the same age as Schroeder. Everything is done via computer and the guy hates it. Doesn't understand technology and openly complains about it. I think that lack of knowledge really hinders Schroeder's ability to make an informed decision.

If he's getting the idea that a hung jury is imminent I think he makes them keep deliberating. In the meantime he's gonna have to hold a hearing while an independent expert comes in to give him the knowledge he lacks. I fully suspect the end point then is mistrial with prejudice.

I agree but defense specifically asked for a mistrial WITHOUT prejudice.

Yes. He crossed state lines with a gun!

I legally cross state lines with a gun multiple times a week. Nobody has attacked me and I have never had to shoot anyone to defend myself.

The same people that you reference would absolutely vote to put me in a cell right next to Kyle if given the opportunity.

Hell can you really blame them? They watched, as we did, as the government they elected for protection turned a blind eye to rioters and let them break and burn millions worth of their livelihoods. They now have the power to protect themselves, and they don't trust the government to do it. Even a strong man might let his rigid morals slip to protect his family in this situation.

Never mind the rich irony of them trying a kid put in the EXACT SAME SITUATION.
