First, even if there was a mistake in his testimony, they don’t have witnesses retesting on the appeal level. Second, by him not being available, it becomes harder for the defense to prove there was an error in his testimony.

but if its successful and a re-trial ordered,, lets say shes 2-3 years into the sentence..
prosecution has to rebuild the case,and decides they dont want to risk the new verdict the might negotiate for time served and no retry

That's not how appeals work. They don't revisit evidence presented at trial and rehear the case. If there was some sort of procedural error to overturn the conviction at appeal, the DA might choose not to bring the case to trial again because the witness is gone. But, barring some technicality or malfeasance that is brought to light, that bitch is convicted and the trial is a done deal.
