First, even if there was a mistake in his testimony, they don’t have witnesses retesting on the appeal level. Second, by him not being available, it becomes harder for the defense to prove there was an error in his testimony.

no not based solely upon an appeal being filed

but if its successful and a re-trial ordered,, lets say shes 2-3 years into the sentence..

prosecution has to rebuild the case,and decides they dont want to risk the new verdict the might negotiate for time served and no retry

I would use this to explain how the now-deceased BLACK man, was predisposed to think ill of cops , therefore misleading himself as a victim of the racist system to see the cop as a killer

That's not how appeals work. They don't revisit evidence presented at trial and rehear the case. If there was some sort of procedural error to overturn the conviction at appeal, the DA might choose not to bring the case to trial again because the witness is gone. But, barring some technicality or malfeasance that is brought to light, that bitch is convicted and the trial is a done deal.

You really don't have a clue what you're talking about. You don't know what you don't know.

If there were a re-trial because of some reversible error, the testimony of the now-deceased witness from the first trial would be replayed to the second jury. The defendant's right to confront her accuser occurred at the first trial.
