Yes sir! KR's attorneys are all very detail oriented. Hopefully her testimony was ingrained in the minds of the jurors. That is bound to come up again in their closing argument.

ME testifying swelling and bruising to both eyes but also a basilar skull fracture. Basilar skull fractures can present with bilateral black eyes. They took a break but her wording toward the etiology of the black eyes will be important for the defense. Was it a symptom of the basilar skull fracture or altercation

Alessi is approaching this cross in a strange way. I’m not sure what he’s getting at. The ME has said in every way possible “I do not come up with a mechanism of death. I give a cause of death by looking at the body”. Take that and go with it… “so you have stated you cannot determine if this was caused by a vehicle strike or not” and be done. This nitpicking is making him look bad.

Medical examiner who was the only qualified professional to examine John’s body post mortem, just testified on the stand to the the fact that John’s injuries were NOT consistent with being caused by a motor vehicle impact. Praying the jury heard this. Game over if they were paying attention.

She specifically said she looked for injuries to his lower extremities, as that is protocol with a pedestrian strike, and she did not find a single injury that represented an impact from a vehicle.
This witness was called by the Commonwealth, and their case is now torched!

Hank Brennan, and the Commonwealth, is a giant piece of crap. Their accident reconstructionist expert has completely changed his report to fit their cell phone expert who said John O'Keefe physically manipulated his phone at 12:32 AM. He gave it to the defense 4 days ago.
Now he's complaining about ARCCA's "late disclosure" once again even though they have had ARCCA's by the deadline that Bev gave them.

I have felt that way since the beginning with the state. Do prosecutors get to decline a case? I can’t imagine who would want their name on this but then I realized maybe they don’t have a choice?

Hank Brennan is a Special Prosecutor that has been hired specifically for this case at a rate of $250/hr. He was paid $230,000 before the trial started. Estimates are that he will be paid close to $1,000,000 by the time the trial is over.
So in this specific case Yes Hank could have absolutely turned down this case.
Hank Brennan is making a mockery of the United States Justice System.

I have a feeling that Bev is going to allow Aperture to change their report in the middle of trial and then cite ARCCA to do it.
Does anyone know if Bev ruled on the motion from the defense to allow experts to view testimony? I remember them not being able to in the first trial and don’t remember her ruling on it here.

That would track with the rest of this trial.
I truly believe that Bev is ignorant on a lot of these issues presented in this case. such as Video meta data and physics involved in a pedestrian strike
Today she asked if Shannon Burgess testified in the first trial. That seems like something she should be able to keep track of.
And Bev is completely blind to her own ignorance.

I agree. I’d like 5 minutes in the ring with that SOB. As Melanie Little has said numerous times, Hank Brennan is the reason people despise lawyers. He is an embarrassment to the profession.
