Not a chance. $3K just for the ER alone, $7-8K if they run MRI's for no reason and how about $5K for three months of chiro "treatment". We will go on the low end and say meds of $8K and $2,500 per month soft tissue for generals of $10K in a moderate jurisdiction. Actual total case value $18K and plaintiff has health insurance so that money can be simply claimed and pocketed under collateral source. Case will be stipulated under $50K to keep it away from a jury and a judge will give it anywhere between $20-30K in a normal jurisdiction. In Orleans parish or any one of the city courts in the state and that number could be $30-$50K depending on the jurisdictional cap. But yea, insurance companies.

That can be said about the insurance commissioner, the public utility commission, judges, and pretty much every elected government official.

With 8K in meds the numbers you mention aren't anything like 4 times what it would be in the jurisdictions I have practiced in. 20-30k would be what I would expect. Anything above that I would consider high.

I am still convinced there are other factors besides settlement values at work in the outrageous LA auto insurance rates.

But most here just think "its the insurance companies fault" and don't understand that for every frivolous lawsuit by teh billboard lawyers, increases YOUR insurance costs. They are suing YOU, the insurance payer, even if you're not involved. Insurance rates are based off of a pool of clients. When 1 client is sued, all other rates are adjusted to take the hit of that lawsuit.
