The 34-year-old TV star Cavallari, meanwhile, is said to believe that she doesn't owe any part of 'Uncommon James' to Cutler, alleging that she funded the business, which sells jewellery, clothing, and home goods.

I mean, if she’s getting half of what he earned during the marriage then I don’t see the issue here.

If they had done this in Louisiana he'd be golden

If he fully funded a startup company during their marriage you know damn well her greedy arse would be trying to get half of it. And the courts would give it to her no questions asked.
Go for it Jay. Put the screws to the system.

But it has to be from earnings made during the marriage.
If someone becomes a doctor during the marriage, one ex-spouse doesn't get half of what the other ex-spouse makes as a doctor for the rest of their life - even after after divorce. He or she only gets half of what was earned prior to the divorce.
"Brand" is even more the separate property of the spouse.
Now, if one spouse opens a business during the marriage, the other spouse is entitled to half the value (or stock) at the time of divorce. The spouse who started that company can simply buy the other spouse out, OR, more likely, just start another business. The ex-spouse can't claim 50% of the earnings from their ex's labor for the rest of his or her life.

You really want to get pissed off? Read the former spouse protection act.
Let's say an Army Lieutenant gets married to a cheating whore who cheats on him and cleans out his bank account in year 2 and he divorces her. 30 years later he retires as a General. She would be entitled to half his retirement pay per that law.

She wants part of his wealth and considers it fair. He wants part of her wealth, and she considers it unfair.
Sounds about right.
Sounds about right.

If she is entitled to half of his nfl pension then he should get half of the brand.

It’s true. I’ve seems this in a family member who was in the Navy. He is now almost 80.

I'm not positive how it is for the military, but that's not how it works for civilians. For that type of pension, she would BASICALLY be entitled to 1/2 of 2/30 (the formula is a little different). For a regular 401(k)type, she is only entitled to 1/2 of the amount that was added to the account during the marriage, plus earnings on that 1/2.
It's hard to believe that what you stated for the military is true. What if he were married 4 times to 4 different woman. They can't all get 1/2 otherwise the military would have to pay 2x's the benefit, and the military member wouldn't get sh!t.
I'm pretty damn positive that there is a formula involved that takes into consideration the time married and the total years of service.

Oh, is that how it works, Kristin? Because I am pretty sure it's not.
Like Cutler or not, he should get the exact same treatment that "ex-wives" get. Are Bill Gates's/Bezos's exes only getting what they "funded" themselves? Something tells me they are getting much more than that.

Not being a smart arse. But wouldn't she would have to give up her spouse benefits to the new spouse (if he remarried) for that not come into affect? Otherwise she would be entitled to it in that nature.
Idk, I'm no JAG.

I’ve been wondering when this shoe was going to drop. If you want equality, you get it everywhere. You don’t get to pick and choose when it applies.
