Odds are you have an ACV policy, they should give you the value of your truck before it was wrecked. Not what it would cost to go buy a new one.

If this hasn't been covered already (I didn't read every response) look up Hayes v. Allstate. Per the judge's ruling, you must receive the full retail price for your vehicle plus sales tax (assuming you're in Louisiana). If you're unsure of your vehicle's price, check NADA.com (National Automobile Dealer's Association).

I'm sorry your truck is ruined, but maybe this info will somewhat ease the sting of your financial loss.

Based on your information I’m betting your truck is worth probably $8,000.

Two options:

1. Take the cash, find a junkyard bed, replace it yourself. Pocket extra cash.

2. Buy a 1988 Pontiac Firebird

Most of my life I've been the anti-injury lawsuit guy. Lately I've been questioning that stance. If everyone else is getting 20k for a neck-ache and I'm paying for it in my premium, why shouldn't I get some of what I'm paying into? Maybe if everyone started suing everyone else it would break the system and we can start over.

Not everyone is getting $20k when the state minimums in Louisiana are $15k, not to mention like 230% of our drivers are uninsured.

Seriously, don't let them screw you. Don't let them tell you what they will do. Don't sign anything, if what they say they are going to give you isn't acceptable tell them its acceptable. Tell them to come with something better and if they don't you will get a lawyer involved. You got to fight with them.

NEWSFLASH!: Insurance rates are always going to go up regardless of claims filed. The number of claims filed is just usually the excuse for a price increase.

at least you are lucky - my wifes car got hit on 280 in Birmingham - guy turned into our lane in a chevy pickup - hit the passenger door, and pushed it in, looked at us and drove away. I chased him to the next light and forced him to pull over.

was an undocumented illegal alien, with no DL, no insurance of any kind.
