US law does not provide for “shut the border.” US law does not restrict asylum claims just to ports of entry. Those were Trump policies that were not in compliance with US law.

The current administration spent months negotiating with Congress to change the law, but republicans have blocked the changes, claiming that no one has to actually comply with the law because Trump doesn’t care about law.

Wrong. POTUS can significantly alter how asylum claims are processed. While potus can’t unilaterally deny all asylum claims, he can force seekers to await the immigration process outside of the US and automatically deny any asylum seeker who sneaks across the border. This authority is known as title 42 which Brandon suspended on day one of his administration.

Plus the patriot act gives potus unilaterally authority to secure the nation’s borders if it’s a national security risk; which the fentanyl epidemic and organized crime from south of the border can easily be argued as a national security threat.
