quote:I just imagined this whole story with the all-star cast of My Cousin Vinny.
I sued Express Oil Company in the 1980s after they ripped my oil pan using an air wrench. I was driving a crappy Isuzu Impulse at the time. The Express Oil mechanic told me his air wrench tore the oil pan and Express Oil couldn't fix it. I told him that Express Oil was going to pay and he said he was sorry but I would have to talk to his manager who was gone to lunch. I called the Isuzu dealer and told them I was getting my car towed to them. They told me that they were going to have to pull the engine and disconnect/reconnect a lot of other parts in order to replace the oil pan. The cost was over $1000. I waited at Express Oil for the manager to get back, gave him the cost and he said they weren't paying to get my oil pan replaced and that my oil pan was apparently defective anyway. I told him right then I was going to sue them. Express Oil showed up to court with a lawyer and their oil change specialist and approached me before the case started. They wanted to settle for half of what I told them it cost me. I told them to shove it. The Lawyer told me I would lose the case since he was smarter than me and I would get nothing. I had prior talked with the Isuzu dealer and sales guy and told him what happened and that I might buy another car from them in the future. The dealer had his mechanic go to court to testify in my defense. I showed up with the paid invoice to replace my oil pan, including towing, and the mechanic testified that they had to pull the engine and all of the other details. He also testified that it was obvious that the oil pan was ripped by massive over tightening that could only be done by an air wrench in his opinion and that mechanics should never tighten the oil plug on an oil pan with an air wrench. He brought the oil pan with him to show it to the judge. The Express Oil mechanic said he didn't use an air wrench and he manually used normal force with a socket wrench. The judge looked at the oil pan and said there was no way that no normal human being could manually rip the metal on my oil pan using a normal socket wrench. The Express Oil guy said that's what happened. The judge asked at what point that the metal was tearing for several inches did he realize that the oil pan was being damaged. The mechanic just threw his hands up. The judge told the Express Oil mechanic was a liar and ruled for the full amount in my favor.

I got a feeling I’m headed to court over a psychopath I tossed out of my hunting club recently. You can find the thread on the outdoor board.

This thread is filled with bullshite.
Still waiting on, “I filed a small claims suit, but I had no idea what I was doing, and I lost majorly.”
Everybody here is a simple country boy who whips a silk stocking New York lawyer.

They are or once was a shady operation. Long story short, they sent me a $10k bill when I had to go to the ER when I had a gall bladder issue (worst pain I ever had).
I called them first to ask if it was a mistake, they told me it wasn't. My insurance told me I should have to pay no more than $150. I called them back and told them what my insurance said and after awhile they finally told me they made a mistake, I no longer owed them. Cool.
Three months later I get another bill for the same amount. I call them again and was told that I did in fact owe them $10k. On the invoice it just had "Transportation and care" or something like that.. $10,000. I told them what my insurance said and that I wasn't paying them $10,000. And could I at least get an invoice with specifics. About 2 weeks later they called me back to inform me I no longer owned them.
I talked to someone else around the that time who told me they had trouble with them as well. Their kid had to be taken to the hospital for something and they got a bill for some insane amount.

Yes. The defendant wound up bringing an attorney, to my surprise, to represent her, so I had go head to head against him.
I actually wound up getting some documents admitted against his objections. I also had access to some stuff I shouldn't have, so I was lucky the judge and attorney didn't press the issue more than they could have. I ultimately didn't prevail, but it was more about making a point.

No but one time on the way to band camp I got a bullshite traffic ticket. I went to court, I got the cop on the stand, and I argued with him until he admitted he was wrong. And the judge, this Judge Malloy. All the while he's laughing and smiling. And then afterwards, he asks me to go to lunch with him. Then he says to me, "you know what? You'd be a good litigator." I didn't know what the hell he was talking about, I don't know what a litigator is. I never thought of becoming a lawyer. But this Judge Malloy, who's from Brooklyn, too? He did it, so all of a sudden, it seemed possible. So I went to law school.

I work with a guy that owns a few rental properties and he doesn't allow pets. There was this one smartass that rented from him and he ended up finding out he had a dog. He said it was an "emotional support animal", had all the paperwork and was being a dick about it how he can't evict him, against the law, blah blah blah.
Well,he talked to an attorney and said that they could get him evicted since he broke the terms of the lease but he only had 3 months left. A month from renewing the lease, the landlord told him that he wasn't renewing and that he had 30 days to get out. Dude starting crying and said he was going to sue. Nothing ever came of it.

If I was the judge, I would have held that mechanic in contempt.
