It disturbs me that our system’s fundamental rules of a criminal trial have so much gray area that even a panel of 7 appellate judges make a decision on a 4-3 split.

E Jean Carroll laughs at you while she goes on TV laughing about spending Trump's money that she won for false accusations.

While I agree Harvey is a POS, these women slept with him to further their career. I guarantee you he isn't the first or last movie producer to offer to cast a pretty girl in a film in exchange for some pussy. It's a tale as old as time.

So it’s of your opinion that Harvey did nothing wrong and is innocent.

Good point.

How hard is it to rig 7 and 5 judge panels?

Moreover, these kinds of tiny judicial panels (or even single judges) are being used to subvert case justice or overturn millions of votes as per State "Propositions"? (see California several times)

You say that in jest, but it is probably not 100% false.

Did Weinstein use his position of power in the industry to have sex with women who he otherwise would not have been able to get? ABSOLUTELY!

Did those women knowingly participate because they wanted the career/lifestyle benefits Weinstein could provide? VERY LIKELY

But the reality is if Weinstein was an attractive guy who could offer the same lifestyle/career benefits in exchange for sex you'd probably have very few complaints because the women would have happily wanted to have sex with him...even though it was essentially the same quid-pro-quo.

I'm sure Leo DiCaprio, Brad Pitt, George Clooney, and Bob Saget traded their power for sex on at least a few occasions. But it was ok because they were good looking.

So basically they didn’t follow procedure? But everyone still knows he did at least some of what was alleged?

Evidence of an uncharged prior bad act can be admitted not to prove guilt in the instant case, but to show knowledge or intent.

Louisiana's versions:
quote:

In order to show intent, evidence is admissible of similar acts, independent of the act charged as a crime in the indictment, for though intent is a question of fact, it need not be proven as a fact, it may be inferred from the circumstances of the transaction.

quote:

When knowledge or intent forms an essential part of the inquiry, testimony may be offered of such acts, conduct or declarations of the accused as tend to establish such knowledge or intent and where the offense is one of a system, evidence is admissible to prove the continuity of the offense, and the commission of similar offenses for the purpose of showing guilty knowledge and intent, but not to prove the offense charged.

All depends on the case and what one is trying to prove by using it.

It's more procedural at this point
He will still be in prison until he dies due to the other rape trial he was sentenced for
