Defense knew Ward was screwed from the jump.

He was adamant that his attempted robbery story would work and he stuck to his fists and feet until it was too late.

Are you suggesting he had ineffective assistance of counsel? The police have never and will never track down every bit of evidence. Once they get what they need they tend to stop. This is where the defense attorney and his/her investigators come in.

I'm not sure what I'm suggesting, honestly. The wording from the D.A.'s office was odd. It seemed like they were implying a video exists, but the jury didn't "need" to see it.

Orleans Parish District Attorney Jason Williams, who tried the case alongside Gaudin and Assistant District Attorney Christian Hebert-Pryor, argued law enforcement officials didn’t need to see the incident captured on camera: “There’s no reason to track down every video when you have eye witnesses stepping up and telling you everything they saw,” he said.

There were conflicting accounts, and it didn't seem like a good idea to obtain independent and objective evidence?

There were? You mean his bullshite story about the knife cutting his hand that he didn't tell the police about or that they made any note of noticing?

Or the small detail about one of the witnesses not remembering where a flower planter was?

This is a slam dunk case. He beat a man to death in front of witnesses.

There weren’t really conflicting accounts though.

The story of him beating on his girlfriend and the homeless guy coming to the rescue was always bullshite.

Maybe the cameras didn’t extend that far out to where it happened and the word of the bystanders that spoke to police and testified on the stand was all they needed.

This is a good time to ask this question again because I don't think anyone ever answered it. Why didn't his ex girlfriend testify on his behalf?

There's no doubt he was guilty and deserves punishment. There were no "conflicting accounts" besides his own self serving testimony. THe only issue is whether he should get 15 years versus 30 years etc.

You keep saying that you don’t know this guy, or his family, or anything about him, but multiple times you’ve expressed how sure you are that he’s going to be a good citizen if dealt with lightly.

Why?

If you go back and look at the litany of Ward threads including the main one I've been hypercritical of him and called out the mouthbreathers regurigating the phony mugging scenario. I may have given the wrong impression ITT. All I'm saying is based on potential sentencing factors 20 something years seems appropriate versus say 30-40. I would hardly call 20 something years getting off lightly. People routinely walk out of prison after serving less than 10 years on manslaughter.

Conflicting accounts are conflicting accounts. It's a simple thing for investigators to gather available evidence to show the story was bullshite. Seems odd that they wouldn't want to do that.

Did Derek Quebedeaux (the murderer at SLU) ever get released?

Seems like Garrett needed his attorney instead.

John Fuller is a fine attorney esp for Nola.

It is pretty remarkable that Jason Williams himself tried this case. That’s how you know the defendant was white.

I haven't followed the story.

How did Ward get caught?

His drunk arse ran to a parking garage and the witnesses informed the police, where he was quickly apprehended.

That's now how the law works. If there is video evidence, the prosecution is required to turn it over to the defense. So that leaves us with a few options:

1) There is no video evidence
2) There is exculpatory video evidence that the DA refused to hand over. This is a major violation, but would not surprise me from Williams's office.
3) There is video evidence that didn't help either the prosecution or the defense.

Not sure why you are so hung up on this, she wasn’t there for the altercation
Why would she be called to the stand on his behalf? To get questioned on how drunk he was that night?

I thought she was a witness to the whole thing in which case I expected the defense to call her. Never mind then.

Obviously Wards attorney thought it wouldn’t have been a good idea to put the girlfriend on the stand.

Considering she moved onto one of his buddies not long after, I doubt she would've had many good things to say about him
