So you think the people getting expelled have had no court dates and haven't already been told to leave?

You said you don't want to live somewhere you have to present papers, yet I bet you do whenever requested by a police officer or other governmental official that requests or requires it.

So entering a country illegally is not probable cause?

So are illegals 100% of who they're forcing to show papers? Of course not. It's peculiar Louisiana folks are now not remembering the i-10 checkpoints we setup to keep y'all out, or the i-95 and i-75 checkpoints as well.

JFC . The person I was responding to was asking why we have due process at all. If you want to read the back and forth go back a page.

Another idiot, I have my passport, DL, and SS card.

You carry your passport and SS card at all times? That’s… odd, but OK. The vast majority of people do not.

As has been explained, the purpose of a hearing is to ensure that you have a chance to prove your citizenship or immigration status before being deported. Even if you don’t think due process applies to non-citizens for whatever reason, it certainly applies to US citizens. If there’s a possibility that a person might be wrongfully deported, they deserve a chance to prove it.

I’m a little surprised this even has to be said, to be honest. Even murderers caught in the act by police are entitled to a trial.

He doesn't get to just randomly stop me for an ID check. There has to be probable cause. It's often bullshite, but that's the way it's supposed to work.

What if you are here illegally? You are looking at this from the standpoint that you can have your day in court as a legal citizen. If you entered illegally you don't have that right. If you are not a US citizen then you are not protected by US laws.

Habit, sometimes you need two forms of ID, but having a passport usually negates it.

They are entitled to due process.

quote:

Eventually, the Supreme Court extended these constitutional protections to all aliens within the United States, including those who entered unlawfully, declaring that aliens who have once passed through our gates, even illegally, may be expelled only after proceedings conforming to traditional standards of fairness encompassed in due process of law.3 The Court reasoned that aliens physically present in the United States, regardless of their legal status, are recognized as persons guaranteed due process of law by the Fifth and Fourteenth Amendments.4 Thus, the Court determined, [e]ven one whose presence in this country is unlawful, involuntary, or transitory is entitled to that constitutional protection.5 Accordingly, notwithstanding Congress’s indisputably broad power to regulate immigration, fundamental due process requirements notably constrained that power with respect to aliens within the territorial jurisdiction of the United States.6

But my understanding is that the majority that are being rounded up have already had their day in court and have been ordered out. They know who they're going to get. For the others, like the raids on meat processing plants, I would be curious to know the process being followed. I haven't seen any detail around it.

We all know that’s not how it usually works. If a cop wants to pull me over, he’s going to pull me over and probable cause is just another excuse to do so.

Hearings are only supposed to be called if the deportee makes an asylum claim. And we still don't HAVE to do even that much. You and others are setting up a strawman, a supposed conspiracy to deport Hispanic citizens “because frick cops” I don't trust them”. Further, you’re demanding an action that would completely swamp courts to the point where cases would literally take a decade or more to be heard, while illegal invaders had the right to stay and build their numbers. You supposedly revere the rule of law, and yet you demand that we allow it to wielded as an enforced suicide pact against the country. Not only no, but frick no. The country does not have to play your game.
