Same reason American and Delta and your Piper Cub can fly over his house.

Google be saying: "Flying in Controlled Airspace. Over 98% of the land in the United States does not require any authorization to fly a drone up to 400' above ground level; however, there are still major portions of US cities that are in controlled airspace."

Yeah I mean the guy is older, probably doesn't understand drones are used for this stuff and assumed someone was being nefarious. Drop the felony charges, make him pay damages and be done with it.

My guess is that a majority of Americans would object to a drone flying low over their property.
