Oasis is alleging that Buccees is selling gas below cost, which per that particular statute, would be illegal, not that gas can't be sold for less than $2.

Correct, the public policy reasoning is that the use of predatory market penetration prices can drive out smaller businesses which can't lose money on each fuel sale and when they are gone prices to the consumer can go above what a more diverse market would charge. Gas is a commodity that you really use the Walmart method to strongarm lower wholesale prices and since the margins are so low you have to sale at a loss to grab large portions of the market.

They were planning on putting one at the now infamous "Golden Corral Exit" but then the flood happened along with some unfriendly business attitudes in our local gov't.

The profit margins aren't in the gas, it's in the groceries.

I am willing to bet the original push for this legislation was from state Republicans.

That’s the best free marketing they could have hoped for.

Also gas stations almost always open with below market gas prices for a few weeks to get people’s attention and alter their usual fueling habits since most people go to the same few places every time.

It’s like science. And marketing. And psychology and shite.

I had to stop filling up at Buckees, I stop there for everything else, but the gas is crappy. I average 1 to 2 miles less per gallon even when using their premium. And if I fill up six or seven consecutive tanks there my truck will idle rough

Wait, so the fuel companies in Alabama have colluding to keep prices high? Isn't that text book price fixing and very against the law?

Think this is pretty much part of their strategy when they open a new location. They opened one up close to us across from a Chevron and gas and diesel prices were lower by $.20 - $.22 a gallon for about a week before Chevron responded. They had a price war that went on for about 5-6 months. Eventually both of them came up but Buc-ees still has the lowest price around here. Chevron is 1 or 2 cents higher usually.

That's what they get for bailing out of the Baton Rouge location.

I know it is foolish to try to justify any law on the basis of ethics that is passed by any legislative body. But can anyone explain to me why selling cheap gas is against the public good?

Maybe they can offer a free bag of Buc-ees nuggets with any gas purchase and some jerky if the purchase is above a certain amount. I guess at that point, the legislature would go after then for offering addictive stuff as gas premiums.

As long as Buc-ee's isn't selling below cost which I do think is illegal, then I fail to see the issue.

ETA: Buc-ee's cost is always going to be lower than everyone else's because they are so big they own their own fuel fleet.

Right.

So Buc-ee's undercuts prices on gas and might even take a hit on the gas, but the net is positive because of all the extra foot traffic buying groceries and stuff.

This is free market. I don't get why this could be illegal in any way.
