The man didn’t come to work after testing positive, he simply dropped off someone at the hospital who had it. If he takes a test and he isn’t positive, how isn’t this wrongful termination?

Well according to OP, he didn't fire him for having COVID, but for not disclosing that he had been in close contact with a covid positive person.
Employment lawyers can chime in on the difference between an employee and a contractor, but you can certainly fire someone for that in an at-will state. You can fire someone just because you feel like it.

That's pretty terrible of you. But they are also beyond stupid assuming you were offering paid sick leave.

Well he could have cashed in on that 2 weeks PTO from the CARE Act and it wouldn't have come out of his PTO bank but he decided to be a company man and show up for work and you fired him?

A company man would have followed the rules, instead he chose to potentially infect the entire staff. The person who got fired is an idiot and it’s sad to see that no one here can see that. But most of y’all are hourly employees somewhere and don’t have the burden of looking out for an entire team and their families.

My job just did something similar to the entire sales team (medical sales), but they did it without knowingly coming into contact with someone that has the virus. Lawsuit is in the works. We were not allowed to work from home either. We all tested negative too.
