Fighting LA OMV: Loss of liability insurance (Update)

Summary: does anyone know who to talk to at a high position at OMV or a lawyer who knows how to deal with them? Contact with them has been extremely difficult

Background: moved out of state and swapped auto insurance. LA OMV picked up that I dropped insurance with State Farm but I guess didn't get notification that I was picked up prior to that by Safeco. After all this, got vehicle registration swapped to new state

Later got notification of cancellation of insurance from OMV and asking for proof of insurance. Submitted.

Later I get another notice it hasn't been resolved. Been going back and forth. Trying to call them. On hold for 2 hours and then got disconnected. Call back again. Says lines are busy and to leave a message. This is infuriating. And now they've turned this all over Dept of Revenue and are threatening to levy it from bank account or garnish wages ($656)

Update: poster LucyLoretta and Staci Hoyt, one of the heads of the OMV, were able to work with me and get my situation taken care of. The power of TD strikes again! ;bow: It's good to know that there are still people who are out there willing to help and do positive things in the world.

Long story short for others: if you're stuck, reach out to someone who is a Public tag agent or find out how to contact someone who is at the head of the OMV.

You’re prolly just gonna have to suck it up and pay it. Had something similar happen. Seems to me like they fricked up and are counting on us to bail them out, because we will. They’ll put red flags on your drivers license and stuff too.

Just pay it and be done. From what I've heard it's almost impossible to make go away. They'll let you spread it out over a year if you want.

I’ve been dealing with this shite for almost a year. The DMV is a despicable laughable excuse for a functioning public agency.

Try calling your new insurance agent. There’s some kind of form that they can send to show an overlap in your insurance coverages so you can prove that you were good at the time

This is what dealing with Louisiana government workers is like. Best advice I can give is to never return because even if you do everything right, it’s doubtful the state employee does. Have fun getting arrested by some podunk cop meeting his quota on the highway.

Be prepared to sue and to point out that you not only switched insurances but moved to another state.


OMV is hardheaded as frick about this and will try to chase you down for not having insurance but be very slow to fix things once they figure out you did and, say, they didn’t bother to mark the plate as turned in when it was actually turned in.

That’s where you fricked up. If it was still registered in Louisiana but you got insurance moved first, that’ll flag you.

Red flagged me when I was in the Corps. Swapped to a local agent in NC and Louisiana screwed everything up. I was pulled over for speeding east of Atlanta one weekend and spent 6 hours in a holding cell because of their screw up. Cost me $685 to get out of jail and another $75 to get my truck out of impound. Louisiana OMV will ruin your day in a heart beat.

You won’t get attorney fees from the State, and even if you get a judgment to that effect, the state doesn’t have to pay it if the state doesnt want to.

Excerpt: Louisiana license plates can be turned in at any Office of Motor Vehicle location, through the mail, or canceled through our online service.

Because Louisiana law requires all vehicles registered in the state to maintain liability insurance, plates must be canceled BEFORE canceling liability insurance.

It is not necessary to turn in license plates that have been canceled through our online service, however, it must be removed from the vehicle and destroyed.

They suspended my license one time when I switch insurance companies. I was covered 100% but stitched my cars over to my motorcycle insurance company and they say I lapsed 1 day on 4 cars... it was expensive. I didn't find out my license was suspended until I got pulled over in Georgia, luckily the Georgia cop wasn't in the mood for paperwork and let me go...

Twenty years ago I had a similar problem with the DMV. I started a new job that I was furnished with a company car. So I sold my personal vehicle and of course dropped the insurance. Fast forward a few years and I changed jobs and had to buy another b er personal car. The DMV claimed that I had no insurance for that two year period, even though I didn't own a car. It took an Act Of Congress to get it cleared up. What helped me was at that time a good friend of mine was close to our State Senator and we got his office involved in it and they contacted the DMV and were able to make it go away. No fine, and no flags.
