If my livelihood depended on my being drug, or alcohol, free, I think I would make taking care of my family a priority. Easy choice...

It's fairly easy to determine how long ago by the level, particularly with blood tests. Post accident investigation determined that they were high while operating the train and that if they had slowed as prescribed when they passed the signal, they would have avoided the accident. Toxicology on the deceased Amtrak engineer indicated he was totally unimpaired and evidence showed his actions actually decreased the negative consequences of the accident.

The problem is about science. It is not whether you are high or drunk at work when an accident happens. The problem is that the human body can process alcohol thru the liver and then it's gone. The body cannot process the weed as rapidly. Remember, a Blood Alcohol Content is just that, how much is in your system, not if you are actually impaired or not.
So there is no way to actually scientifically know if a person is high or drunk, only that they do or do not have it in their system. And in the court of civil law, that is all that matters. Remember, in civil court, you are guilty until you prove yourself innocent. Alcohol or drugs present in your system provides all a civil court needs to sue your arse (or your company) for negligence.
So until science comes up with a better way of testing for "under the influence" instead of "in your system", sorry weed smokers, you gonna have to stop if you want to keep your job.

Blood tests can test for THC, and saliva tests have a short window of detection to see if you smoked recently.
So most companies go with the pisd test, to test for metabolites that stay in your system long after you stopped smoking and don't impair you.

What is funny to me (funny curious, not funny "ha-ha") is that someone in an office setting that drug tests can go home, get rip-roaring drunk and maybe beat their wife or kids for good measure, and as long as he comes to the office sober...
Take the same office setting where someone smokes weed once or twice a week to help alleviate stress in the comfort of his own home, on his own time, hurts no one, doesn't show up to work high, and his work is not affected at all. However, he pops positive on a random piss test. No matter how productive he is, how dependable, knowledgeable or useful he is...
