they are not responsible for trimming the tree but by law they can trim the tree...if the tree damages their property the people who own the tree are responsible

This is hilarious, I would just pass it on to your lawyer for a laugh and not do anything.

It starts with this but it will lead to...

-could you move my couch?

-will you help take this to the road?

-will you rub my feet?

-will you lance this boil?

-I messed myself, will you help me with this?

Send them a bill for your fence and driveway. You warned them that their tree was rotten.

Ok so for part two then? Is he responsible for replacing or simply repairing? Who decides what is what? If just hammering a few fence boards gets it good then why the frick pay for a whole new back fence.

Just ignore them and avoid confrontation. Old people have a lot more time on their hands than those that work, have kids, hobbies. They can really cause bigger issues than this so I'd be cautious about being too big of a douche.

On disrespecting elderly people, I was thinking about something along these lines the other day. I respect the elderly, no doubt, but let’s think about it for a second… When people are not elderly (I just regular joes and janes before say 60-70) they have some level if smartness. There’s a lot of dumb people out there in general. When they hit that magic “elderly” number, they don’t become instantly not dumb. So, if I have trouble respecting dumb non-elderly folks (I more just tolerate them), why should I have to respect dumb elderly folks (as opposed to just tolerating them)?

What type of fence?

Whose property is it on?

If it's on the property line, then I could see sharing the cost of replacement.

Here's a good blog on tree liability (and far more accurate):

Just a standard 6' wooden fence. The crazy part is it's her fence along the back of her yard. The trees hanging over her fence causing the fence problem are on her property. Our home is next to hers. That fence is 100% hers and the tress.

Anyone ever had a similar situation

Somewhat. A tree that barely survived the hurricane is 95% or more on their property (very large tree. Probably 75 feet high). It was leaning and rotten and was coming down sooner or later. Keep in mind, they had a tree in their front yard go down but in the street. It would have been a house killer. They wanted no part of the removal. We paid 100%.

Offered to go half and half on a pine tree that's easily 15 feet on their property. Very large tree like the other one and it's leaning also. They decline and ignore us. It's not leaving towards my house but when this thing comes down, 1 and possibly 2 houses are screwed.

These people aren't elderly but they just don't give a shite about their yard.

They did give a big shite about their crepe myrtle two years ago. I had jasmine growing into the crepe myrtle for years. Looked really good and some parts were as thick as the handle of a baseball bat. Well she sawed straight through all that shite.

Who cares about their 200k home, the neighbors house, my house, but frick this vine it's going down because of my precious crepe myrtle.
