You'd be correct in that assumption.

I think the driver may have moved the car forward again into the mob, Mr. Foster goes ahead and fires 5 shots into the car. There is a long pause between him firing and return fire. Which I can see as to the driver ducking, scrambling to grab the pistol, finding Mr. Foster as the threat and eliminating said threat.

Both of us agree to the stupidity of Mr. Foster's actions.
