Well, good luck. My neighbor took a shovel to my yard in an attempt to make water flow uphill. He has been there for 35 years so it was okay for him to do that. He was doing us a favor after all. You know, he can't inherit me and the other neighbor's drainage problem by us allowing our yards do drain into the ditch that is completely on my own property thence to waters of the state. He was entitled to the dirt in my yard to build a levee halfway into the state highway drainage that my property drain flowed into,...to, you know, direct the water up hill in the ditch along the state highway because that is where it has gone for 35 years.

When confronted about the digging he had no clue what the 4 strange sticks with orange flags represented around my house shortly after i bought it because of course he owned everything at least 5 feet on the other side of the strange ribbon clad shafts of pine. Priceless was the look on his face when the undeniable truth was revealed to him. Still, the only sliver of an apology he could muster was "well, i guess i went a little too far."

Idiots are a dime a dozen. Try to be nice and compromise as much as possible. Your deal seems to be more in the grey and could get very expensive should things escalate. I didn't take my idiot to court. He knows damn well what he did was wrong and i could have taken legal action. I just gave him my number and said to call me if he is worried about something and let it end there. Bad blood with a neighbor sucks. There is much much more that came out when i confronted my stupid neighbor all because he didn't get a survey 35 years ago when he bought his house.

If what you say is true about his property used to drain on to yours then it is his problem to find drainage. I could see his case if you were now draining everything on to him. Why is it your problem that you are no longer allowing him to drain everything on to you? It isn’t.

Actually no, I know this because I shot the damn thing with my dirt guy and understand the elevation. My house is exactly 10' from the back property line and house pad is within 5'. I have it crowned approx 1/2" in the center and the rear of the pad is approx 1/2-1" higher than the front of the pad. All sides slope to the road.

So your "knowledge base" for your ignorant comment is non existent.

You can’t make a dam with your pad that causes your neighbor’s property to flood.

ETA: Well you can but in most places you’re not supposed to.

Those are good questions. We'll have to wait until the OP updates the thread and reveals how it all works out. It probably won't be resolved in a day or two.

I'm guessing here and going off of aerial imagery, but I don't think that's the case. It looks like after Rita, the two houses that had a driveway across OP's property did clearing and grading and created those swales. Looks liek OP's neighbor was already sheet flowing onto OPs property. I say that because it looks like they put a culvert under the driveway. That's my educated guess.

Honestly could this all be taken care of by cutting ditches across the back and along the sides of your land or could it as well be fixed if he did ditches. I would hate to have that dispute with a neighbor if there was a simple fix.

Google your neighbors first and last name and lake charles. 6th hit is meeting minutes from city of lake charles. Page 6. He and his wife were bitching about drainage back in 2016.

Yea I mentioned a couple pages back. They have bitched every single time someone built on our road.

Yes but as mentioned throughout the thread, there is a fiber optic cable that runs along the edge of our adjoining property. Kind of important not to hit it.


I will receive ruling from the city planning office tomorrow in writing. But I'm still gonna do what I can to get it draining. Gonna be tough with the fiber optic cable, but gonna do the best I can. Also will consulting my real estate attorney.

Bottom line is it's going to be a lot cheaper to do whatever I can to help him. At a minimum on a temporary basis. If I have to go to court even if I win, gonna cost me more. This thread has shown me that and as this thread proves this is a very gray area And never know how the court will rule. Can't chance that.

Us as other have said, last thing I want is a pissed off neighbor that calls the cops saying I'm too loud every time I go outside.
