Dispute with apartment about lease agreement

My lease is supposed to end June 20.

A lease in any other realm automatically ends.

I emailed the office asking them to confirm my lease expiration date nearly 2 months ago...

They responded

"Yes your lease expires June 20th. We will send you some renewal options in a few months for you to review."

That was the end of the email.

They sent me some renewal options two weeks ago, to which I responded "I will not be renewing my lease"

They hit me with some "we need a 60 day notice before you leave" to justify that now instead of my lease terminating June 20 it now terminates July 14th.... and I will owe them an extra $2000 because that is what the rent amounts to as a "month to month" to cover the difference between June 20 and July 14.

I'm fuming. Livid.

Threatening small claims court and bad reviews etc.....

Thoughts? Is my anger justified?

It seems that they intentionally obfuscated the fact that I need to TELL them that yes my lease expires and I'm moving out.... they should have included that in the email about my lease terminating. It just seems so greaseball and fricked up.

Read the lease, it has to explain all this in the terms

All they can do is ding your credit and you can dispute it.

Well. Does the original lease say you need 60 day notice?

Did you original email say:

I intend to move out.

Or

My lease ends on two months, correct?

Seems pretty cut and dry.

Its amazing how many people sign shite without reading it. A lease is a contract, know the ins and outs of what you're signing and I'm willing to bet it clearly states you need to give 60 days notice the way most all leases do

Why should they have to tell you what is written in your own lease?

Depending on how your initial email was worded, that might be your way out of it. Decent mgmt should accept that as a notice that you weren't renewing.

I just pulled up a lease we had a while back and it clearly states on page #1 top right

"Notice Of Termination or Intent to Move Out"

a minimum of 60 days written notice is required

eh, i'm one that always says read your contract but this is ticky tack if they come back to you on it. you asked about the lease ending. No, you didn't say specifically "I am leaving my lease in 2 months". I feel like what you said should suffice, especially considering that they said they'd send some other stuff. Then they drug their feet into within the 60 day period.

I'm willing to bet this is a game they've played before. If the renewal terms suck, you're already within your 60 days so you either:

a) pay them extra $$ to get out like they want now in your current situation or
b) suck it up and go with the sucky renewal terms.


eta: i'm not saying the landlord is wrong, i'm saying they're an a-hole.

Also the fact that they gave you renewal options clearly shows they had no idea you had planned to move out and acted in good faith and weren't intentionally screwing you by not telling you policies you should have already known and read yourself. How about instead of emailing them, call them or go to office so you can get details and go through all your options.

Sounds like you have no leg to stand on it court and you should be livid and fuming at yourself.

Is not giving notice. This is just asking when your current lease expires. How are they suppose to know you’re leaving vs intending to go month-to-month?

Tell them they'll need to speak to your lawyer.

If you don't have an actual lawyer friend, get a friend who can play a convincing lawyer.

They'll fold.

If it is month to month, it means he doesn’t really need to give much notice now does he?

Month to month implies either side can give notice and end the agreement.

That's the default rule, but the lease can change it.
