Prosecution has been a clown show so no surprise they're pulling this

This team of prosecutors have been completely outclassed by Nelson, put on a horrific case that leaves enormous doubt, and now tries to side door some BS evidence on late notice. What a disgrace

they're going to likely present testimony that the carbon monoxide levels was due to environmental factors

I'm not well versed on criminal trials but to me this ruling seems absolutely ridiculous.

Ellison has screwed this thing up from the beginning. I always have contended this is a dog and pony show. If he was serious they would have let the Feds handle this as a Civil Rights case.
Maybe I am wrong. But we all knew Chauvin was going to walk once the facts came out.

I think with this prosecution lawyer asking the questions, there is now a 50/50 shot at a mistrial.

i'm curious what happens if this prosecutor completely fricks up and the doctor does testify to stuff that creates a mistrial. it will be borderline intentional at that point.

They rested their case already. Is there precedence for reopening? If there isn't , tough shite for them.
Its allowed, BUT ONLY as to rebut evidence presented by Defense. NOT allowed to advance new theories.
State back on at 1015..... and that prosecutor should be absolutely be walking on eggshells at the podium as judge made it clear that State is flirting with a mistrial .

What happens if the defense attorney tricks Tobin into saying something about test results?
I’d imagine held in contempt, but mistrial also?

Prosecution is doing this on purpose for a do over since they know they got worked?

If the prosecution deliberately causes a mistrial isn't that somewhat circumventing double jeopardy?
Posted on 4/15/21 at 10:03 am to LRTiger
Not sure why he is asking questions at all. It is ridiculous to me that Chauvin can get possibly two or three not guilty from the jurors and its a hung jury and they can retry him. With chances to fix their own frick ups.

I believe that is what is called "opening the door" and then at that point all bets are off. The State could then ask them.

This is a clown show. I'm confused why they are allowed to call this witness again? Admittedly, I don't know enough about the legal process but can the defense just call another witness to rebut the prosecutions testimony?

Defense brought up carbo monoxide level tests
Prosecution's witness, on his own, got rebuttal evidence via new tests (i think)
State wanted to call him as a rebuttal witness to discuss these new results
judge said state had notice of issue and could have presented these issues previously and rebuttal evidence about new tests would cause a mistrial
So thats a good thing for the defense right?

Yes but bad news that they get to call their best witness again.
