Nelson stated that if Tobin's report and new testing, which he argues was a State oversight, is grounds for a mistrial and he would move for the same if the Judge rules it admissible.

This seems very calculated from the prosecution as stated by Nelson. To get their best witness back in front the jury one last time.
ETA: if he goes for mistrial if this is allowed, who makes that decision? how does the court arrive at that?

So if they get a mistrial declared they will have to retry the charges, but will they use same prosecutors?

The prosecution must feel like their case is weak as it sits if they are attempting to throw more spaghetti and see if even one strand sticks.
They rested their case already. Is there precedence for reopening? If there isn't , tough shite for them.

Judge announces Torbin not allowed to testify regarding carbon monoxide in blood due to late disclosure on lab tests. Can be recalled to discuss other things though
