Just saying…if someone is too drunk to consent, that same standard applies to males as well.

If they all had drunken consensual sex and they dropped her off at a random spot, however shady and unethical and immature, a crime has not occurred.

I want to hear more details as this plays out, but I’m not convicting these guys merely because the girl was drunk (as many seem to be doing). Im guessing the guys were drunk as well, considering they were all out at the same place. I think the BAC conversation becomes moot and irrelevant if all parties were drunk and the sex was consensual.

Didn’t necessarily mean “scoop”. Really meant no comment at all. Not even a passing mention. I thought he might have said something to let the public know he is on top of things.

They weren't drunk. Their lawyers aren't even using that as a defense. They were coherent enough to perform sexually. They were coherent enough to wait outside the car while the other had his turn with her. They were coherent enough to have sex in a cramped car backseat in the dark.

As far as we are aware based on the evidence revealed, they were not tested as the victim was. They can say all day and night they were loaded, but if no evidence exists to suggest if they were or were not, I believe that point becomes moot in the eyes of the law. Also no matter what any video does or doesn't show, her BAC level (if accurate) is considered close to the beginnings of alcohol poisoning. Even a verbal "yes" at that BAC level could potentially be considered irrelevant. Anyone that's gotten very drunk has probably done and said alot of things without remembering any of them.

Remember that intoxication generally is not a defense. Also remember that Carson was driving, so he is unlikely to have been blind drunk.

They were not interviewed until days later. There will be no BACs on the accused.

If I understand your point, they would not be guilty of a crime if they too were drunk? IOW, they may have been incapable of discerning that she was incapable of consenting? So that would make it no crime?

I think you're asking a mostly legal question. And fortunately there a couple of lawyers who post and are kind enough to keep the rest of us from devolving into absurdity (with varying degrees of success).

To me, how would your scenario be fundamentally different from a teenager on drugs playing in a street daring someone to run them over. And you being inebriated get in your truck and oblige. I don't think it'll pass muster to claim 'I was too drunk to know they were on drugs.' A crime was still committed. "No sober, no crime" is not a defense IMO.

How long do we expect before we hear if the Grand Jury recommends charges and what they might be? I know this is a guess.

By tomorrow afternoon should have public news on it.

Charges?

3rd degree rape is what they were arrested for.

What's possible?

First degree rape is possible. Carries a possible life sentence.

If they made a video, video voyeurism.

If Madison was run over "seconds" (family attorney said that) after being put out of the vehicle, could be manslaughter or negligent homicide.

All of those are possible.

But TD member "Judge Holden" will likely chime in here with his (more informed) take.

Intoxication level is usually not a defense to most crimes. It can be a defense if you are claiming that you are involuntary intoxicated, (drink spiked or someone literally forced alcohol down your throat), or if the crime you are being charged with requires specific intent and your intoxication level precludes you from being able to have specific intent. But in the vast majority of cases if you voluntarily got drunk it will not be a defense.

There`s nothing the defense can do to change the fact that the 2 idiots took advantage of a drunk girl with a BAC of .319 and raped her.

In fact, if this is the videos to be shown as evidence with the obvious audio selectively edited, it just makes it look like it would further incriminate them.

The defense has a pattern now of submitting evidence like the first one to the judge, that helped get them arrested initially.

With the statements already made by the idiots and the additional videos, they are just digging a deeper hole for themselves.

You’re defending these rapists. Washington has been charged to the point where he could very well spend the rest of his pathetic life behind bars.

I would wager there’s more victims this Washington serial predator has raped who have yet to come forward. The POS deserves to be publicly hanged.
