Especially in emotionally-divisive things like this. I’m not one to pick a side early. I want to know more.

Life is not always as black and white as news articles make them appear

Honestly I don’t give a F about the victim, or the defendants, but if I’m on the jury I want to know as much as possible before deciding. And while I’m not - yet - on the jury, I definitely haven’t decided in my own mind.

This is a factor, but it might cut both ways with some jurors.

Pretty people do better in life. That is pretty much proven. They tend to be more easily successful, they tend to be happier, and they are more likely to be leaders than others of similar skill. I would say it follows that pretty people as victims are going to get a better shake from the jury. But maybe not.

As for her being a female, well, I am not sure that helps a lot in every rape case. Look at all the baws on here who are terrified of some gal claiming rape or "me too."

More important for this case is that she passed away, and that she is not the accuser. No one can infer that she is "crying rape" when she cannot say anything at all.

As for race, you all hash that out, like you do every day on the OT. I don't think that discussion is useful here.

I do think that social status might bear on this. She was not just pretty, white, and female, she seems to have been affluent. We see pictures of her on ski slopes, with her sorority, etc., etc. And from what I gather (and I don't know this), she went to a fairly nice high school. She was not a shrimper's daughter from Delcambre, or a paper mill worker's daughter from Port Hudson.

It may seem odd to some people that she would have gotten into a car with these country boys from a significantly lower social economic standing. The jury will have to account for that because it does not fit the way things usually happen. One narrative will be she was too drunk and vulnerable to make any other choice. There may be others.

They may very well have raped her,and if so, they deserve the punishment. Nonetheless, they still deserve a defense.

If I ever have sons I would hope someone would defend them here.

and they will get one. Regardless of being found guilty or innocent they still are POS for what they did....consensual or not.

There has been plenty of posts questioning why the woman gets the benefit of the doubt when drunk and men don't. but this isn't "date rape" this appears like 4 scum bags preying on a drunk girl.

Maybe. Probably.

But it could also be drunk woman preying on cute drunk guys and public sympathy going to the one that died in a very complicated/blurry/drunk situation.

Looks like there's also a 'revenge porn' law in Louisiana now as well against sharing photos as well.


The whole 'well they drunk, too!' defense - amazing how often that has come up. Law says 'reasonable person' could judge victim wasn't capable of consent.

Words of the defendants: "I guess" and 'drunk drunk' should do it as well.

“Based on a disagreement, she got out of the vehicle. She indicated she was getting an Uber. I want the public to know, these young men or really the driver of the vehicle and the young men that were in there, did not put her off on the side of the road,” said Haley.

That's one attorney that needs desperately to reread the Louisiana Criminal Code.

An aggressive prosecutor needs to address this case. If found guilty by a jury of their peers, the defendants should all get the chair.

How drunk is this girl in your hypothetical situation? Drunk enough to stand in front of an oncoming vehicle? That drunk?

Do we even know if she was standing in the road?
I haven’t heard any details of the accident.
If she’s as drunk as the BAC test says she could have even been laying in the road.
Really, really drunk people have been known to lay down almost anywhere.

I pulled over a vehicle once in westwego that was drifting out of lane alot, and overcorrecting across the opposite lane stripe. That was the pc for the stop.
It was a white female. She could barely stand up, and barely could talk. Definitely a 98. I forgot what she blew on the intox 5000 in Gretna.
