That is a good point. They likely were told they were the last to see her alive and Washington is quoted as having said that. So they thought it was just about her death and had no clue about rape charges until - in Washington's case - they asked for DNA sample and then he shut up fast.

You can argue all you want that the driver should have done this or that to avoid hitting her, and you can have a valid point with it, but regardless of that he will always be 100% not at fault for hitting a human being in his lane on a highway where it's illegal to walk across. That's how the law works.

at 3am? that is pretty much the darkest part of burbank except when you pass Staring and get closer to Siegen/Highland. Also some people don't see as well at night or have bright headlights. Was it a moon lit night/cloudy etc.

Drivers are required to take reasonable means in avoiding an accident. If a car stalls in the highway, you aren't allowed to just plow into it b/c it's in your way.
I don't think we have any idea, what actually happenned. The Uber driver may have been driving the speed limit and had their hands at 10 & 2 and eyes locked on the road when she jumped out in front of him. It's also possible that they were speeding and/or messing with a phone accepting another job. We don't know. And unless there is a dashcam and/or rider in the Uber, we probably will never know. I'm guessing this stuff will play out in a civil case at some point.

It would be messed up if her family sues the Uber driver. I realize they are hurting and have a huge loss but IMO if anyone has a lawsuit it would be the Uber driver for damages to their car for a wreck that isn't their fault...not that they should sue though.
