Because it matters to the result. It’s a shitty lawyer who doesn’t understand both sides of a case. And I guarantee the prosecutor will think about these things when deciding how to charge them and whether to plead them.
If you can’t see that, well, I guess nothing will help.
I’ve said many times I think they go to jail. When they do, it won’t be because of you and Roger the Stubby’s “opinions.” It will be on cold hard analysis of the whole case.

The biggest thing is going to be the video of what took place inside the car. The defense atty is saying it shows it was consensual, which is pretty much impossible considering her BAC.

What if it does and it’s post sex? The defense seem pretty confident about it, and this is what they’ve suggested.

Only way it could have been affected from IV fluids is if they drew the blood from above the IV site. Alcohol swab used to draw blood "could" affect the results, but not very much. Hopefully they cleaned with betadine. That's what I always did and made damn sure I charted it was cleaned with betadine as well. IV fluids never did too much to sober drunks up in the ER. Only time helped.

First, I never said the fluids had ANY effect on blood alcohol CLEARANCE. I said that the added fluids to her blood would dilute the sample, making it appear less than it was.
They study you reference is referring to a BREATH test measurement of BAC levels. I promise that they drew blood, she was likely unable to provide a breathalyzer test after being hit by a car. The BLOOD SAMPLE would likely be diluted, being that fluids were added to it.
