If Washington is tried and convicted in LP before the EBRP court trials, would that fact be submissible in the EBRP court trial for all 4 of the idiots?

I saw that too. And the affidavit says it was a blood sample.
So maybe the defense flips it. They say it was a diluted sample and, based on the methods used, would have been an undiluted number so high she couldn’t have walked, when we know she did walk into the street. So there must be something wrong with the measurement.

For him only if he takes the stand. Code of Evidence 609.1.
Otherwise it’s inadmissible under Rule 404.

The threshold is supposed to be the same. But no doubt the prosecution would try a little harder to keep that value in evidence. Their words have no bearing on whether or not it gets accepted.

The defense is going to also try to poke holes in BAC based on the timeline. 1) when was her last drink, 2) the timing of the sex & 3) the time of the blood draw.
The sex/rape happened almost immediately after they left the bar. It is possible she was drinking late in the night and the defense would argue that while her BAC was .319 at the hospital it would have been lower at 2pm.
I saw Reggie’s claim she didn’t drink for the last hour but it’s hard to believe them as they are in CYA mode.
